Summary/Abstract: Aspects relating to the suspension of forced execution have generated ample discussions over time in literature and judicial practice, even if no special controversy has been encountered. The situation has been attracted, we appreciate, first of all, by an antonymy between the principle of effective enforcement and the expediency enforcement of enforcement titles, on the one hand, and the observance of the legality and, sometimes, of the contradictory nature of the procedure. In such a situation, verifying the admissibility requirements of the application for suspension of forced execution is a mandatory step precisely to ensure the legality of a firm intervention on the course of the enforcement procedure.
