Violation of the Constitution of Republic of Poland and the scope of liability of public officer for the crime stated in Article 231 of Polish Criminal Code

Summary/Abstract: W artykule przeanalizowano odpowiedzialność funkcjonariusza publicznego za „bezpośrednie” naruszenie Konstytucji, jak i odpowiedzialności funkcjonariusza publicznego za podjęte działania stanowiące prima facie wypełnienie ciążącego na nim obowiązku (realizacji przysługującego mu uprawnienia) w sytuacji, w której zdarzenie prawne (aktualizujące konkretny obowiązek lub uprawnienie) – w uproszczeniu – narusza Konstytucję RP. Article analyses the issue of criminal liability of public officer in two aspects. First of all, in cases of “direct” violation of the provisions of Constitution of Republic of Poland. Secondly, in cases that at first glance can be considered the fulfilment of the duty, but the factor deciding on the actualisation of this duty constitutes an violation of the Constitution.
