Summary/Abstract: Autorka prezentuje uwagi do prezydenckiego projektu nowelizacji Kodeksu karnego oraz ustawy o postępowaniu w sprawach nieletnich, który ukazał się 5 września 2016 r. Celem projektu jest zwiększenie ochrony osób małoletnich poniżej 15 roku życia oraz osób nieporadnych ze względu na swój stan psychiczny lub fizyczny. W artykule krytycznie odniesiono się do projektowanych zmian, wskazano również na niekonsekwencję polegającą na braku nowelizacji art. 10 § 2 k.k. oraz stosunkowo krótki okres vacatio legis projektowanej ustawy. The author presents comments to the presidential draft amendment to the Criminal Code and the act on proceedings in juvenile cases, which appeared on September 5, 2016. The project aims to increase the protection of minors under 15 and those who are clumsy due to their mental or physical condition. The article critically refers to the proposed changes, also indicated the inconsistency consisting in the lack of amendment of art. 10 § 2 k.k. and a relatively short period of vacatio legis of the draft law.
