The crime of terrorism financing in the amended Article 165a of the Polish Criminal Code

Summary/Abstract: Na mocy międzynarodowych zobowiązań wprowadzono do Kodeksu karnego nowy typ czynu zabronionego, penalizujący finansowanie terroryzmu (art. 165a k.k.). Przepis ze względu na trudności interpretacyjne oraz wąski zakres penalizacji był dotychczas dwukrotnie nowelizowany. Autorzy poświęcili niniejszy tekst na ukazanie ewolucji art. 165a k.k. od momentu jego wprowadzenia do Kodeksu karnego do jego obecnego brzmienia. Celem artykułu jest przede wszystkim analiza zmian, do których doszło w strukturze przepisu na skutek nowelizacji z 27 kwietnia 2017 r. Ponadto autorzy poddają weryfikacji potrzebę karania za finansowanie terroryzmu odrębnym typem czynu zabronionego w kontekście regulacji aktualnie istniejących na gruncie Kodeksu karnego.Pursuant to international obligations, a new type of prohibited act was introduced into the Polish Criminal Code which penalizes terrorism financing (Article 165a). This provision, due to the interpretational difficulties and the narrow scope of penalization, has already been amended twice. The authors present the evolution of Article 165a from its introduction into the Polish Criminal Code to the present day. The aim of this study is to analyze the changes that occurred in the structure of the provision as a result of the amendment of 27th April 2017. In addition, the authors also verify the necessity to punish terrorism financing using a separate type of prohibited act, especially in the context of various others provisions of the Polish Criminal Code.
