Summary/Abstract: The subject of the article is to discuss normative changes in Article 197 of the Polish Criminal Code proposed in the draft amendment by the Sejm (print no. 2154). This amendment introduces new aggravated types of offenses specifying: rape with the use of a dangerous object, rape of a pregnant woman, recording the image and sound of rape, rape resulting in severe health damage, and rape causing the victim's death. In addition, rape of a minor under 15 is recognized as rape with extraordinary cruelty for which a criminal sanction has been heightened. The introduction of the abovementioned changes is not justified, and, in addition, this regulation causes many interpretative and systemic problems.
