Three questions about marriage and civil partnerships

Summary/Abstract: The present study focuses on the case law of the European Court of Human Rights on the positive obligations of the States arising from Articles 8 and 12 of the European Convention on Human Rights towards same sex couples and it reaches the conclusion that Article 8 imposes on the State the obligation to arrange a civil union for those couples.
