Summary/Abstract: Under Romanian law it is possible to apply directly the provisions of an international instrument in the area of human rights. This option was not considered an effective remedy under the article 13 of the European Convention on Human Rights. Therefore, taking into account the recent judgments finding Romania in breach of article 13, a clear legislative intervention is needed.
