THE DOCTRINE OF THE CONSTITUTIONAL COURT OF THE SLOVAK REPUBLIC IN ELECTORAL MATTERS

Summary/Abstract: The article analyzes the doctrine of the Constitutional Court of the Slovak Republic in electoral matters. In the opinion of the authors analyzed doctrine consists of three basic steps: 1) unconstitutionality and illegality alleging infringement of the Constitution and laws relating to elections, 2) relationship between this unconstitutionality and the illegality and void election or void election of candidate, 3) intensity of unconstitutionality and illegality, which already calls into question the election results, which raises reasonable doubt about whether the elections and their results are a manifestation of the real intention of voters. These elements are discussed in abovementioned article with actual examples from the current practice of the Constitutional Court.
