Summary/Abstract: The Paper considers the Asperation Principle, which is the institute of criminal law. The Paper does not analyze it from the Perspective of criminal law, but is devoted to its constitutional aspects. The Paper refers to the decision of the Constitutional Court, where it judged the compliance with the principle of proportionality in affecting the fundamental rights and freedoms as a result of the application of the Asperation Principle.
