Summary/Abstract: The contribution is dealing with problems in implementation of program documents in the field of air protection. The attention is focused on the short-term action plans. At first, the action plans are dealt with at the EU law level from the historical point of view. Then Directive 2008/50/EC on the ambient air quality is analysed regarding to the obligation of EU Member States to establish short-term action plans. The other part of this contribution is devoted to the Czech national legislation. The previous Air Protection Act required adoption of short-term action plans, while current legal regulation left out this obligation. The authors are trying to answer the question, if the Czech legislation is in compliance with the EU law requirements. It was found out that Directive 2008/50/EC established conditions under which the EU Member States have a duty to adopt short-term action plans. These conditions are not met in the Czech Republic; moreover, the Czech Air Protection Act established other legal tools to regulate excessive concentrations of PM10 particles reaching beyond the EU law requirements.
