Summary/Abstract: Regulation (EC) No 1907/2006 of the European Parliament and of the Council of 18 December 2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals set the duties not only to producers and importers of chemical substances and preparations, but also to other persons in the supply chain. The article is dealing with enforcement mechanisms in relation to this Regulation in general and at the national level. Czech legislation is based on administrative liability for non-compliance and the law covers all infringements of REACH using „catch-all provisions“. On the other hand, the problem was found with setting sufficient level of fines to meet the requirement for penalties to be effective, proportionate and disuasive.
