Criminal Law Protection Against Violence Against Women Based on Cultural Differences

Summary/Abstract: The subject of this article is the various forms of violence against women and the analysis and characterization of the main cultural differences as a reason for their realization. In this regard, a comparative review of the legal framework of certain crimes against women in individual countries and according to the Bulgarian Criminal Code has been made. Taking into account the contemporary realities, this article draws attention to Decision No 13 (promulgated in State Gazette No. 65 of August 7, 2018), according to which the Council of Europe Convention on the Prevention and Combating of Violence against Women and Domestic Violence, drawn up on 11.05.2011 in the city of Istanbul, signed by the Republic of Bulgaria on 21.04.2016, does not comply with the Constitution of the Republic of Bulgaria. With a view to prevention and adequate and comprehensive counteraction of the examined forms of criminal behavior and the introduction of relevant international standards, some legislative proposals, de lege ferenda, have been made aimed at improving the Bulgarian legal framework.
