Summary/Abstract: The article is about the significance of medical documentation evidence in medical error courtcases. This is a quite important issue, as in the light of the binding law we cannot say that medicaldocumentation is of evidentiary value greater than other evidentiary means. Yet in fact, thesignificance of medical documentation goes beyond a simple assumption that this is privatedocument evidence, because on the grounds of medical documentation, courts often make numerouspresumptions of facts and assess the physician’s diligence. Judicial decisions should besupposed to still evolve in the forthcoming years, modifying the role and significance of medicaldocumentation evidence.
