Determination of the amount of compensation for unjustified convictions in reference to a court practice

Summary/Abstract: An unjust punishment for imprisonment is the premise for applying for compensation. The analysis of issues related to the problem of due compensation due to unlawful deprivation of liberty in a criminal trial is inseparably connected with civil law, in particular by the claimant’s compensation or compensation for damages suffered or injuries suffered. The State Treasury is responsible for the damage caused. In the published case law of the Supreme Court and the appellate courts regarding compensation, the analysis of the amount of the analysis was made for the purposes of this study.
