THE CLAIM WITH THE CLOSURE IN ROMANIAN CRIMINAL LAW

Summary/Abstract: The sentences of deprivation of liberty continued to occupy the first place today in the scale of the penalties in the laws of the different countries, having a repressive function and a preventive vocation. Legislations have created three types of penalties, which correspond to the three categories of crimes (crime, crime and contraventions); the first type was the criminal punishments, subdivided, in their turn, according to the seriousness of the facts, in forced labor for life, for a limited time and the heavy prison; the second type was the correctional prison and the third police prison. To these three categories, punishments corresponded to special places of detention and their own disciplinary regimes. The preconceived idea of the existence of different categories of offenders, based on the seriousness of the crimes committed, against which they have to act differently, was the basis of the mentioned categories of punishments.The custodial sentence, however, remains a basic punishment in criminal repression in all countries, with some changes occurring in the modern prison system, especially regarding the execution of the different categories of custodial sentences. It was found that the diversification of the enforcement regime according to the categories of punishments provided by the law is artificial. The different solutions that are required during the execution of the sentence are determined by the penitentiary treatment, since the problem of the re-education of the convicts varies according to each individual respondent, to whom he must have his own treatment, capable of correcting his behavior, for the social reintegration.
