Summary/Abstract: Starting from Jean-Jacques Rousseau's statement that „any disinterested judge must admit that the song is, after all, the soul of music”, the legitimate question that can be addressed is that what is a musical work? The answer must be given by law, which shows that it is an intellectual work of creation, original, with or without text. In this context, the line that separates the originality of plagiarism is quite fragile and easy to break with or without knowledge. In this context, the article presents some of the cases of plagiarism inmusic recorded over the time.
