Summary/Abstract: Civil liability is the common law in the field of patrimonial legal liability, contrib¬uting to the protection of the legitimate rights and interests of all persons. Civil liability is manifested in its two forms, tort liability and contractual liability, both having the same purpose – the full reparation of the damage caused , but the distinctive elements raise the question whether, in the process of recovering the damage, it is possible to choose the most advantageous form of civil liability or favourable provisions of each species of liability. The answer is negative, argued both on the relevant legal texts and on practical considerations.
