Summary/Abstract: Used from the beginning of speech, throughout life, with its own meaning woman in relation to her children or figuratively source, origin the word mother could not bypass the all encompassing field of natural law – jus naturale and the positive law. The Romanian legislator enshrines numerous provisions from which its protection and protection emerge, especially in terms of filiation, recognizing as the mother of a child only the woman who gives birth to him, rejecting the juridical fictions resulting from the gestation for another.
