Summary/Abstract: This article is an attempt to highlight the significance of the structure of the share capital as an institutional solution to ensuring a certain degree of security of business transactions. For many years, he questioned the meaning of the use of this instrument to achieve that objective on the function of guarantee to the creditors of the companies. Therefore, in the world take to the numerous reforms of introducing alternative mechanisms of protective measures conducive to promoting the development of entrepreneurship. However, empirical data indicate the effectiveness of this type of action, which leads to the conclusion that it capital is still, practical an important instrument to ensure a certain degree of security of business transactions and fully irreplaceable role as a fund starting in companies.
