GENERAL ASPECTS OF DISCIPLINARY RESPONSIBILITY

Summary/Abstract: Disciplinary liability is a form of legal liability specific to labor law, comprising all the legal norms that define the disciplinary deviations, establish the sanctions and regulate the substantive and procedural conditions for their application. Being specific to the employment relationship, the disciplinary liability intervenes whenever the employed person violates the obligation to respect the labor discipline. This type of liability has a contractual nature, a strictly personal character, exercising sanctioning, preventive and educational functions. The presented material treats the institution of disciplinary liability as an integral part of the legal responsibility provided in the specialized legislation in the field of labor law; also aspects regarding the characteristics of the disciplinary responsibility, the notion and the elements of the disciplinary deviation, as well as the description, application and cancellation of the disciplinary sanctions will be addressed.
