Summary/Abstract: Discussions are currently on the extent of the legal capacity of minors and the position of their parents as legal representatives (so-called child debts), on the assessment of the best interests of the child in this context and on the exercise of collisional custody, that the social and legal protection authorities of children should exercise this function as a priority. The issue of child representation arises from the legal regulation of parental responsibility and legal capacity of a minor. In connection with the exercise of parental responsibility, it is currently becoming apparent that parents do not always actively and effectively represent the child. The article therefore responds to some problematic areas concerning both the representation of the child and its legal capacity.
