Special evacuation procedure for buildings used or occupied without right

Summary/Abstract: The article analyzes the Evacuation of buildings used or occupied without right, introduced in the Code of civil procedure in Title XI, of Book VI, Special Procedures.The scope of this procedure refers to disputes regarding the evacuation of the used buildings or, as the case may be, occupied without right by the former tenants or other persons.This procedure is very useful because it is limited to summary debates and the judgment is enforceable.The promotion of the appeal or the appeal during the execution, is not suspensive. In order to suspend the execution the defendant must give in cash, at the disposal of the creditor: the rent or lease to which he was obliged; the amount established to insure the rent or lease rates due up to the date of the suspension application and the amount related to the rent or lease rates that would become due during the trial.
