Summary/Abstract: Vicarious promise is a new legislative concept, which is not regulated by the Civil Code of 1864. The current Romanian Civil Code establishes the legal regime based on the opinions expressed in doctrine and jurisprudence prior to its entry into force, but comes with some new elements.
