Summary/Abstract: This short study focuses on the question of whether compulsory use of alternative dispute resolution, as and when required by law, may hinder or impede access to justice. Relevant European Union acts and recent case law of the EU Court of Justice and the European Court of Human Rights have been examined. The Courts' criteria are set out to be applied by national legislators and courts to provide sufficient guarantees to safeguard consumer rights in the EU.
