Summary/Abstract: The article provides an analysis of the use of undercover investigators and collaborators in Romanian judicial practice in the light of ECHR jurisprudence and also of the aspects that must be considered in order to avoid a breach of the fundamental right to a fair trial enshrined in article 6 of the European Convention of Human Rights. The author draws attention upon the need of a full legal harmony between the Romanian judicial practice and the new realities enforced by the continental and EU law.
