Summary/Abstract: The aim of this paper is to present the legal position of employee as a patient in the law of the Republic of Serbia from the aspect of the right to privacy and protection of personal data. First of all, the solutions of applicable legal acts and by-laws are presented in detail, and the case law is reviewed in order to comprehensively understand this topic and to indicate its increasing importance. In the context of all this, the authors also made their suggestions on how to overcome the shortcomings in legislation and legal practice and how to improve in that way the exercise of the right to privacy and right to protection of personal data of employed patient.
