Summary/Abstract: These notes examine some disputable aspects of surrogacy contract and consider its compatibility with the law of obligations principles. The author focuses solely on some problems of the gestational surrogacy, by which the embryo is not genetically related to the carrier (surrogate). These brief notes do not tend to be comprehensive, but they can be useful and challenge a constructive discussion in sensitive public fields.
