The Constitutional guarantee of the collaboration between the Parliament and the Government in the legislative process regarding the normative acts involving budgetary expenditures

Summary/Abstract: The provisions of the fundamental law provide for an entire mechanism of separation and balance of powers - legislative, executive - within the constitutional democracy, meaning that the provisions of art. 111 para. (1) and of art. 138 para. (5) of the Constitution, which uses different notions related to the collaboration between the Parliament and the Government in the legislative process regarding the normative acts involving budgetary expenditures. Against this circumstance, on the occasion of the a priori constitutionality control, by jurisprudence, the concepts included in the reference constitutional texts were identified and developed, being established certain guidelines as a guide for subjects with the right of legislative initiative, which through legislative initiatives configures certain novelties or legislative changes with financial impact on the expenditures from the state budget, reflected in the content of the normative act. Thus, in the content of this article, we will set out some jurisprudential landmarks on how the collaboration between Parliament and Government should take place in the legislative process on normative acts involving budgetary expenditures, by virtue of constitutional provisions.
