Planned transformation of offenses into administrative torts in Poland

Summary/Abstract: The subject of the article is the phenomenon of transforming offenses into administrative torts, which was given the name of conversion. The author drew attention to the problems resulting from changes in the law that were introduced in relation to the prevention, counteraction and combating COVID‑19 and other infectious diseases. It was noticed that the time of the pandemic caused chaos, which is also visible in the legal regulations established by the Polish legislator. It was indicated that certain solutions may raise doubts not only from the point of view of the implementation of the ne bis in idem principle in the case of liability conversion, but also compliance with the basic principles expressed in the Polish Constitution and procedural guarantees of the party to the proceedings.
