On the Confession in Bulgarian Criminal Proceedings

Summary/Abstract: One of the European standards with a centuries-old tradition is the rule that confession is made freely and voluntarily. In order for this to be ensured, certain requirements should be provided for and fulfilled. This article makes an up-to-date complex analysis of the role of confession in criminal proceedings in accordance with the operative national, European and international legal framework. A general characteristic is presented of the accused person’s right to give explanations as one of the basic means of ensuring his/her right of defence. On the basis thereof, the specifics of confession are outlined as a product of the oral means of proof, and an updated definition of this institute is presented. Special attention is given to the evidentiary effect that confession possesses. Consideration is given to the regulation of the institute, this regulation being inspired by the philosophy of the basic principles laid down in the operative criminal procedure.
