Amendment of Indictment in the Penal Process

Summary/Abstract: The article attempts to define the principles on which the amendment of indictment in the Penal Process is based. Their manifestation is studied at all stages of the development of the process. In respect to that a view is founded that an amendment of indictment exists in the course of the police proceedings, despite the fact that there are no such regulations in the Penal Procedure Code. The article analyses and systematises the practice of the Supreme and the Supreme Cassation Court in order to point out which decisions become irrelevant and which of them can be put into practice after the latest amendments to the Penal Procedure Code of 1999.
