SESSION SUBJECTS IN ADMINISTRATIVE LITIGATION

Summary/Abstract: Law no. 554/2004 regarding the administrative contentious represents the guarantor of the defense of the rights, freedoms and legitimate interests of the natural and legal persons against the discretionary power of the public administration. The situation of legal equality in which the parties of a litigious legal relationship developed before a court, is not identical in the legal relations born between private individuals and the public administration. Therefore, the public administration authorities are in a position of superiority in relation to private individuals (natural persons, legal persons under public or private law) with whom they enter into legal relations. Precisely for this reason, Law no. 554/2004 created the necessary and useful tools by establishing the subjects that can notify the administrative contentious court, for the defense of the claimed rights, the legitimate interests and the reparation of the caused damages.
