The Role of the Prosecutor in Costs Reimbursed Process for Granting State-Guaranteed Legal Aid From the Guilty Person in Criminal Proceedings

Summary/Abstract: Free access to justice is one of the basic principles of the rule of law. Legal aid is a key element of access to justice and the state is obliged to guarantee it to poor citizens. It happens that wealthy persons receive legal aid from the state funds. These persons have committed crimes and they can pay for these services on their own but taxpayers pay for them. It is unfair and incurred costs should be reimbursed to the state. In such situations is very important the role of the prosecutor.
