The organizing of work outside the employer’s premises seen from the perspective of personal data protection

Summary/Abstract: Work outside the employer's premises has at least two valences: the protection of the employee's personal data from the perspective of intrusion into his/her private life, and the protection of personal data that the employee processes in the course of his/her work, whether there are his/her personal data or personal data which he/she processes under the employer’s authority. For both categories of personal data the technical and organizational measures are similar, leaving it up to the employer to implement them and ensure their compliance. Regarding the intrusion into the employee's private life, we consider the demarcation line between intrusive/non intrusive as very fine and the employer's mission to monitor the activity while respecting the employee's privacy as a very difficult and sensitive one.
