Summary/Abstract: The processing of personal data involves operations that may pose threats to data subjects. Not coincidentally, the new General Regulation enshrines, in the first recital, the fundamental right to the protection of personal data. Among the data subjects, minors constitute a ”vulnerable” category, due to insufficiently formed discernment. In the matter of personal data, the age of the data subjects is a factor that generates particularities inherent to the protection. In particular, the grounds for the processing of personal data are required to be examined in accordance with the insufficiently formed discernment of minors and the obligation to inform the controller. Issues such as the use of information society services (offered directly to minors), profiling are expressly regulated, in terms of consent.
