Summary/Abstract: The author attempts to examine the rules of differentiation of fictional characters, extracting them from the public domain and identifying the properties which enable independent protection. Taking into account the type, scope and composition of the features attributed to these characters, the author examines how the internal structure of a character and the relationships with derivative works affect its status in American copyright protection.
