Summary/Abstract: The article reconstructs a theoretical model of a fictional character and its persistence in time on the selected examples of copyright law cases in the context of the philosophy of fiction. The author analyses the legal dispute between Leslie S. Klinger and Conan Doyle Estate Ltd. over the rights to the character of Sherlock Holmes, working on theoretical and legal assumptions and decisions of the jurisprudence, from which some ontological issues arise concerning the nature and evolution of fictional characters.
