- Summary/Abstract:The article aims to address the problem of so called artists’ estates. In Western countries there are a number of institutions which act in this field whereas in Poland the issue of artists’ estates has not been sufficiently recognized and, even more so, included in the system framework. The article presents the examples of solutions adopted in Germany, which enable to preserve the integrity of the artist’s estate. It also shows that artists’ estates require an interdisciplinary approach, which may lead to the dialogue between various milieus and result in a broad, multiperspective view of the work of art.

It analyses the phenomenon of corporate collections as an art branding strategy and the functions these collections have in the art market system. A corporate collection combines advertising and art protection. On the one hand, it promotes artists’ activities and creates the image of a company, on the other hand, it stores works of art. This phenomenon is perceived against Nicolas Bourriaud’s theory of relational aesthetics, which assumes aesthetic participation and allows to follow the evolution of the new model of aesthetics.

- Summary/Abstract:Works of art inspire admiration and encourage reflection. However, the question arises whether a work of art can also be destroyed. The aim of this article is to analyze two famous case studies – the destruction of Banksy’s painting (The Girl with Balloon) at the Sotheby’s auction in London and the painting Portrait of Doctor Gachet by van Gogh, which – according to the intention of the Japanese millionaire – was to be burned together with his corpse. Both cases refer to an age-old problem – where is the boundary between the artist’s will and the right of the owner, and the common good. This problem is part of the debate between liberalism and communitarianism, and it is at the same time an exemplification of a hard case in law.

- Summary/Abstract:One of the sources of financing the terrorist quasi-state in Syria and Iraq, the so-called Islamic State, was illicit trade in pieces of cultural heritage looted from the controlled territories. This paper aims to present forms of organized looting, destruction and illegal trade in works of art acquired by members of the terrorist organization ISIS, with particular emphasis on the legal aspects of the destruction of cultural property and trade in illegally acquired works of art. Some of the countries which possess large collections declare to be guided by the principle “what was stolen should be returned”, others avoid the subject. The article aims to explore if and how selected former colonial powers deal with the problem of returning stolen works of art, what legal forms they use and what the final effect of their actions is. The solutions discussed are those adopted in France and the Netherlands.

- Summary/Abstract:The article is an attempt to diagnose the problems related to the looted works of art and their restitution. The paper tries to examine relations between different public administration bodies, which are responsible for the recovery of the Polish heritage. The main focus is put on the Ministry of Culture and National Heritage and legal frameworks it uses to succeed. Further and deepened study of the biggest and most important venture of the authorities – the electronic Database of Wartime Losses – allows for a better understanding of historical and systematic problems the state faces when trying to reclaim what once belonged to the Poles or was part of public collections. Lack of coordination and cooperation both between governmental departments and public institutions with privately-owned enterprises calls for the administration’s immediate and substantive actions.

The author of the study calls this view into question, making an attempt to answer the question whether it is possible to “dictate” a plastic work in a legally relevant way, i.e. to establish it verbally by the author and – at the same time – to fixate it by a third person – other than the author.

- Summary/Abstract:The analysis of the system protecting personal goods and personal copyright allows for showing similarities between both institutions. Therefore, it is crucial to answer the question if it is possible to protect the relationship between the artist and the work within the system protecting personal goods. The article analyses two concepts: protection and exclusion of protection of relationship with the work within the framework of the system protecting personal goods, which leads to the conclusion that it seems important to consider more broadly the concept of exclusion within the framework of the system protecting personal goods. The conducted analysis allows to distinguish the concept of “creative process” and compare its meanings, which appear in the case law and the science of law. The arguments presented in the text support the separation of this concept from creative activities and understanding it from the angle of creativity referred to in article 23 of the Civil Code.

- Summary/Abstract:The article analyses the usefulness of articles 23 and 24 of the Civil Code for protection of works of art and the relationship between copyright protection and the regime for the protection of personal rights. The text draws attention to a different understanding of the concept of “work” in the Act on Copyright and Related Rights and the concept of “creativity” in the Civil Code. The author points to the most important differences between the above-mentioned protection systems, in terms of both the object and the subject matter, and from the perspective of the claims of the entitled entity. - Summary/Abstract:The purpose of this paper is to propose a demonstration of the tool that is Creative Commons licenses (CC licenses) as one of the responses to the problem of striking a balance between private and public interest in copyright law and to analyze the level of compatibility of selected aspects of CC licenses with the Polish copyright system. In the copyright system there is a recurrent issue of balancing between the private interest of creators (manifested mainly through the property copyright) and the public interest of society (understood as the right to culture). The article discusses the issue of CC licenses as license agreements, as well as the legal nature of CC licenses, which affects the legal situation of the licensee, since this issue lies closest to the idea of free culture and ensures the widest possible access to culture.

- Summary/Abstract:In the realities of the Polish legal system, there is a noticeable tendency to adopt new, detailed legal acts (the so-called special acts) whenever there is an intention to implement an investment that is important in the opinion of its originators. One of such legal acts is the act on legal procedures concerning the construction of the Westerplatte Museum. As the project initiator explained, the basis for the enactment of this act was the assumption that the implementation of such an investment in the ordinary course could be too delayed. Taking this perspective into account, selected regulations of the special museum act were analyzed in the text of the study. The conclusion is that most solutions to the special museum act are conducive to streamlining the procedure for issuing a permit for a museum investment.
