Summary/Abstract: This text is a brief description of customary law in Africa and its key institution –palaver (conference and debate of elders from a specific community in the shadow of a large tree). The article emphasizes the importance of this law and its relations to the written law of postcolonial states as well as to international law. This paper aims to encourage research in this direction and shows that learning about the legal traditions of Africa, can have considerable practical significance, in particular in the human rights sector.
