Summary/Abstract: The obstacles for investments in the Republic of Croatia are often mentioned. It is usual to blaim, for the difficulties that are evident, the poor legislative framework, the weaknesses of the public administration etc. This is one of the reasons for using special legislative framework, to eliminate the aforementioned weaknesses. The examples of the Golf Courses Act, which should have solved the problems of investments into golf courses, and the Strategic Investment Projects of the Republic of Croatia Act, which should, in general, simplify the legal based procedures and shorten the time limits for enforcement of such projects are illustrative. The author sets the question wether adopting these laws is justified. Then the author questions wether the state, by passing such laws, admits its weakness? Furthermore, the author analyzes the constitutionality of aforementioned laws, the manner of their passing, and their alingment with other positive regulations of the Republic of Croatia.
