L’établissement des institutions de l’Église grecque-catholique à Baia Mare (mag. Nagybánya) et à Baia Sprie (mag. Felsőbánya) a réellement commencé au cours du dernier quart du xviiie siècle. Sur les dix doyennés de l’évêché de Moukatcheve (mag. Munkács), situés sur le territoire de comté de Szatmár, deux ont été nommés pour cette ville minière. Cette région proche du Maramureș (mag. Máramaros) et de la Transylvanie est devenue une partie intégrante du comté de Maramureș au milieu du xxe siècle. Cette réorganisation administrative a fait croire à plusieurs spécialistes roumains – de même qu’au grand public – que le patrimoine matériel greccatholique de la région pourrait être traité ensemble avec le patrimoine culturel régional de Maramureș. La présente étude montre que des églises en pierre grecques-catholiques de la fin du xviiie siècle présentent des particularités locales que l’on rencontre aussi à Baia Sprie, Cetăţele (mag. Györkefalva) et Tăuţii de Sus (mag. Giródtótfalu). La maçonnerie des églises est très simple, dépourvue de détails architecturaux complexes, mais cette pauvreté est parfois compensée par des toitures monumentales. Une toiture mansardée a été montée à Cetăţele, tandis que l’église de Tăuţii de Sus a une énorme flèche. La première partie de l’étude propose une révision des données sur l’histoire de ces églises à la lumière des sources découvertes dans les anciennes archives de l’éparchie de Moukatcheve au cours des dernières années. La deuxième partie est consacrée à des analyses détaillées des iconostases des églises de Baia Sprie et Cetăţele. La comparaison des deux ensembles révèle qu’ils ont été réalisés par les mêmes ateliers. En ce qui concerne la critique du style, leurs peintres sont identifiés comme « Ştefan de Şişeşti » ; en ce qui concerne leurs sculpteurs, aucune donnée n’a encore été trouvée à ce jour. Une particularité des deux iconostases réside dans le fait que non seulement les portes royales battantes et certaines structures ornementales sont chantournées, mais ces chantournements caractérisent également l’arrière-plan des icônes dans l’axe central, ainsi que celui des apôtres et des prophètes. Quant à la représentation de Dieu le Père, elle est en relief. L’Auteur suggère que ces choix peuvent représenter une innovation dans la qualité esthétique qui ne pouvait être achevée que dans les intérieurs lumineux des églises en pierre. Dans le cadre de la présente étude, des tentatives ont été faites pour explorer les antécédents et les parallèles de ce phénomène sur le territoire de l’éparchie de Moukatcheve.

Often, in times of trial, many Christians either weaken in faith or lose all confidence in God’s care, succumbing to fears of unbelief. Others, on the contrary, in such moments are strengthened in the faith and put in God their whole hope of redemption from the diseases or dangers with which they are investigated, following, with full confidence, the recommendations and exhortations addressed by the Church. There are also some Christians who see in such a time of trial of faith through sickness, suffering, and even the death of many of their fellow men the arrival of apocalyptic times, with all the procession of persecutions against Christians. For the latter, any measure taken by the authorities to limit the effects of pandemic diseases or calamities, which affects the freedom of public and communion of faith, is evidence of the persecution of Christians. And if the Church, understanding the necessity and effectiveness of such measures for all citizens, and therefore for the Christians she pastors and cares for, accepts to respect them, she is accused either of apostasy, or of ecumenism, or of others such “sins” of death. On the other hand, on a position antagonistic to them, are those who have renounced the faith in God, atheists and free thinkers, who militate, not so much out of concern for the good of their fellow citizens, but out of hatred for God and the Church, for the complete closure of churches and the prohibition of any religious manifestations.In such a situation, in which the attitude of the Church is challenged by a minor but very vocal part of its members and by its few but also more vocal opponents, for those who want to understand the actions of the Church beyond the preconceived ideas, the truncated scriptural texts they invoke, the scenarios of the conspiracies that I believe the world anti‑Christian occult sets up, a foray into history and a search for documents on state action and the Church’s response and attitude during past pandemic episodes would be enlightening.

This sparked the creation of its separate combat diving unit, imbolded by the actions of their pioneer: commander Constantin Scarlat.

The Law is perceived as an autonomous system of norms which (pretends that) has a certain inner coherence. Much of this coherence is due to the internal logical structure of its normative propositions. The norms are interlinked with each other by logical implications such as inference, causality and non contradiction. The technical structure of the norm itself is expressed as a logical proposition having a hypothesis and a statement. Legal reasoning is itself based on a logical syllogism. Being based on the rules of logic, the law defined its own system of rules as a subset of deontic logic similar to that employed by the study of moral rules. Nonetheless, the system proclaims its self sufficiency (based on a certain form of autopoiesis) by assuming that the existing norms are able to lead to the deduction of all other norms necessary for the good administration of justice. This paper explores precisely this assumption by looking at the incompleteness theory advanced by Gödel in the interwar period. In this way, it can be traced the growing incompleteness gap once one moves from rules designed to regulate simple relations between individuals to those meant to regulate complex relations between groups of individuals. In order to show the utility of the research, the last part of the study tries to build synthetic formulae (expressed in formal logic symbols) able to describe the main legal relations. These formulae could be later on used in analyzing the legal reasoning. The purpose of this exercise is to shift the focus from the analysis of norms to the analysis of relations, from the logic of “must” to the logic of “exist”.

The Byzantin and the Syrian historiography mentions an encounter between the two Great Fathers of the Eastern Church, sometime in the fourth century, an encounter that modern critical historiography deems very unlikely to have happened. Whether the actual encounter happened, or not, its meaning appears overwhelmingly important to the state of the Ecclesiastical conscience of the time, which shadows the factual. The apocryphal narratives provide information of a tacit intention to promote the equality in rank of the two Great Fathers, their spiritual unity, a shared theological vision on doctrine during the post-Nicene period, and, not the least important, the complementarity of their methods; St. Ephrem the Syrian opts for a symbolic-poetic approach, whereas St. Basil the Great for a dogmatic-conceptual method. They both struggled to dismantle the rationalist, neo-Aryan theology, and to ensure the preservation and transmission of the unaltered mystery of faith. In this study, I demonstrate that both Great Fathers opted for the apophatic metaphor Word-Silence to transfer the antinomic pair Hidden-Revealed into discourse. St. Ephrem the Syrian poeticized the ontological abyss of Creator-Creature, and forbids humans to gain access to what has not been revealed. He also finds that the only accepted reaction to Divine Love is angelic doxology. On the other hand, St. Basil the Great develops an entire theology of mystery and of the silence that makes the very core of Revelation, by operating a difference between dogma and kerygma. „The margin of silence” of the sacred Word, a theological metaphor coined by Lossky, means that the mystery and silence of the Revelation elude those outside the Church. At the same time, being inside Tradition, entertaining a permanent communication with the living mystery of faith belongs to those who are already inside. Thus, St. Ephrem the Syrian and St. Basil teach us that theology is not a sterile, intellectual discourse on God but living Word that appears within this burning, vivid silence.

The Holy Fathers of the Christian Church felt the spiritual value of the art revealed by God and appreciated it as an expression of sublime beauty, having as its principle the molding of man according to the archetype of eternal values. They saw in God the Artist of creation and the sanctifier of man and sought to deepen them by the most expressive means possible. They weren’t painters, but they admired painting. They were not sculptors, but they turned to the refined forms of the raw material. They were not musicians, but they tasted the harmony of sounds. For their strength in expressing beauty, the Holy Fathers introduced in their writings references to painting, sculpture and music in order to highlight by comparison the beauty of human structure and the ultimate meaning of man who is reached through the art of the beauty of spiritual life. The purpose of this study is to study how the Holy Fathers related to painting, sculpture and music and used the vocabulary of these arts to highlight the beauty of human structure and spiritual life.

Symbolic burials are well-known features of the European Neolithic and Copper Age. Contrary to the original interpretation as being the graves of those dying far from home, they are rather means of carrying complex messages within the funerary customs. By analysing 139 features in detail, it proved to be possible to better understand this complexity.

The article offers a glimpse into the potential of a series of recent LiDAR based explorations, in cases combined with geophysical prospections, pin-pointed excavation and radiocarbon dating of enclosures, to contribute to the better understanding of the anthropic modified relief morphology and layout of several hill-top sites from South-Eastern Transylvania dated in the Bronze and Iron Ages. The study area, which is mostly forested, gathers one of the largest concentrations of Late Prehistory and Protohistory earthworks known on the territory of modern Romania. The presented data opens the pathway for the further exploration of relevant themes such as: diversity of the functions played by enclosures, the sites’ level of interconnectivity and the existence of hierarchies. It also points out the general need for establishing more accurately the earthworks’ chronology, topography and occupation intensity.

In a famous text called Laus Dedali. Tăcere, the historian Vasile Pârvan imagined an Athenian sculptor: Alegenor. While he sculpted, the artist felt that silence was the shortest route to himself, instilling a more personal and atypical expressiveness (less tributary to the Greek aesthetical canon). Pârvan does not use the word sculptor (he tolerates the partial synonym digger: seeker, hunter, explorer of all paths within a rock). The shapeless rock is a labyrinth, a disentangled bunch of roads towards a possible Centre of the creator, towards the ideal form of his work, which corresponds without coinciding with it, which fits without replacing it. A digger penetrates the rock, a carver chips it off, thus remaining more or less on the outside. Alegenor’s silence is inquisitive: he touched every doubt to provide an exit, a solution, a road to his existence. Such a silence placed one’s being on a pathway, at the end of which man would openly acknowledge what he would choose to be.

Officially declaring the climate emergency by the European Parliament, the advances in low-carbon technologies, and the accreditation of their productivity and competitivity, along with the EU assuming the leadership in the global action of enforcing the Paris Climate agreement, have determined the European Commission to assume, on December 11, 2019, the European Green Deal a new strategy for sustainable growth, where eco-climate priorities become social and economic opportunities. Having at its center the environmental transition and following two fundamental objectives – the substantial reduction by 2030 of GHG emissions (at least 55%) so that by 2050 Europe would become the first carbon neutral continent – the programming document will be enforced according to a “roadmap” containing 50 hey actions, for the following three decades. Amongst them, the European Climate Law (regulation), the 2030 Action Plan and the EU Adaptation Strategy to climate change play a major part in attaining the two major objectives. As launched on December 9, 2020, the European Climate Pact offers a space for dialogue, information and implication of the general public in developing, deciding and enforcing new policies and strategies. This affirms a model of development, eco-climate solidarity and European leadership for the 21st century. The Covid-19 crises has generated the adoption of a relaunch strategy where the environmental stake is joined by the sanitary priority and the acceleration of digitalization. Rethinking the nationally an EU determined contributions in GHG emission reduction has determined a new EU strategy at a national level. Romania’s National Recovery and Resilience Plan, conceived as a vision for developing the country using EU funding, asks for the adoption of an original conception, according to the new EU perspective on sustainable development, expressed as a national “green deal”. Though the legal developments imposed by the European Green Deal, the regional legal regime on climate registers important progress and by this, certain evolutions towards a climate law, in general, and an EU law of climate change, in particular.

Le texte publié ci-dessus réunit trois communications données à desréunions scientifiques organisées à Iaşi (Jassy) entre 2015 et 2020. Elles reflètent l’intérêt de longue haleine de leur auteur pour tout ce qui touche à l’histoire des villes de la principauté de Moldavie au Moyen Âge. Cet intérêt a toujours porté,en premier lieu, sur les sources (diplomatiques, narratives, épigraphiques,sigillographiques etc.) de l’histoire urbaine, interrogées pour connaître d’unemanière plus précise, par exemple, les premières mentions des villes, l’existencedes sceaux et leurs emblèmes (ou armoiries), les institutions et les communautés(organisées par métiers ou par ethnies), l’existence d’un patriciat urbain et sacomposition etc.Le premier volet est consacré aux résultats d’une longue et persévérante recherche concernant l’histoire d’un très important monument historique de la ville de Botoşani, à savoir l’église édifiée en 1496 par le prince Étienne le Grandsous le vocable du St.-Nicolas (aujourd’hui le monastère de Popăuţi). Cette ample reconstitution est due à l’Archimandrite Luca Damian, ancien supérieur du monastère de Popăuţi, actuellement supérieur du monastère de Bistriţa, dont la passion pour la recherche historique est très connue et très apprécié. Le R. P. Luca s’est proposé de faire remonter les dates des premières mentions documentaires tant pour la ville de Botoşani, que pour la cour princière dont l’église St.-Nicolas avait joué le rôle de „chapelle palatine”. Dans le premier cas, on propose de remplacer l’année 1439 (la plus ancienne mention de la ville connue aujourd’hui) par 1388, lorsque le patriarche arménien (catholicos) de Sis, Théodore Ier, a établi la juridiction de l’archevêché de Lwów (Lviv); parmi les villes qui abritaient des colonies arméniennes, assujetties à ce siège, le document mentionne Btiny, que les spécialistes ont identifié auparavant avec la ville de Vidin (en Bulgarie) et plus récemment avec la ville de Botoşani. L’auteur exprime ses doutes envers cette nouvelle identification et propose des recherches et des réflexions plus approfondies. Quant à la cour princière, dont la première mention documentaire connue jusqu’ici date de 1615, le R. P. Luca la fait remonter à 1608 (suite à la solide analyse d’un document mal daté) et propose même l’année 1601, suggérée par une chronique plus tardive. Mais pour remonter encore plus d’un siècle, il reprend la controverse concernant la dalle funéraire découverte en 2001 dans l’église St.-Nicolas et ayant appartenu à un vornic de Botoşani qui aurait décédé en 1492, interprétation chronologique qui –selon l’opinion de l’auteur – reste tout à fait improbable (v. ses arguments dans cette même revue, tome XXXII, 2014, p. 249–263). Le second volet concerne une inscription découverte en 1803 dans l’église arménienne Notre Dame de Jassy (Iaşi), qui, selon cette inscription,aurait été fondée en 1395. Or, l’authenticité de ce document en pierre – qui pourrait offrir la première mention certaine de la ville – a été contestée, en soupçonnant une forgerie plus tardive. L’auteur propose de réfléchir plus attentivement aux circonstances qui peuvent peser sur un jugement positif, pour réhabiliter le message historique de cette épigraphe. L’existence des Arméniens dans la principauté de Moldavie est attestée avec certitude au cours des années’80 du XIVe siècle, tandis que l’existence de la ville de Jassy est attestée par une liste russe des villes, datée aux alentours des années 1380–1390. Une forgerie dans le domaine épigraphique aurait été inutile, vu que l’église elle-même existait déjà au milieu du XVe siècle.Le troisième et dernier volet est consacré à l’analyse d’une source exceptionnelle pour l’histoire de la ville de Suceava (ancienne capitale de la principauté), mais presqu’inutilisée du point de vue prosopographique : le catalogue (ou registre) des fourreurs et des pelletiers, réunis dans une confrérie ou guilde depuis le XVIe siècle. L’examen du document, daté en 1673, semble prouver qu’il soit le résultat d’une compilation ayant utilisé l’ancien registre cadastral de Suceava – renouvelé au temps du prince Vasile Lupu (1634-1653),mais perdu depuis –, plusieurs obituaires et certaines chartes princières. Ce registre (catastif), quoiqu’incomplet (plusieurs pages ont été arrachées ouabîmées), offre les noms de plusieurs habitants de Suceava (artisans, marchands,fonctionnaires urbains), ordonnés selon les rues qu’ils habitaient. Une confrontation minutieuse avec les autres sources écrites (actes de vente,témoignages, notes sur les manuscrits et les livres, inscriptions funéraires etc.) pourrait donner une image plus serrée de cette communauté urbaine, avec ses voisinages, ses réseaux, ses alliances matrimoniales, ses solidarités, c’est-à-dire avec tout ce qui formait la vie de cette ville.

The Văleni village in the historic county of Fălciu, located today in Vaslui County, was not the object of a scientific research or of a monographic study, a large historiographic phenomenon in the post-decembrist period. Through this study, weelucidate the flow of ownership and the owners of Văleni estate from the beginning of the 17th century to the first half of the 19th century and we contribute to the elucidation of genealogical matters. Văleni estate and the ones from around – Sârbi, Dănceşti,Ciorăşti, Străşineşti – passed from the possession of the Scarlet brothers from Zorleni to the boyars from the known families Lupu, Jora, Codreanu and then to Eforia Școalelor from Moldova, as described in this study in detail.

À travers plusieurs études, publiées les dernières années (dont certaines dans cette même revue), l’auteur a envisagé divers aspects et segments concernant l’histoire de sa famille (documents et monuments, branches et personnages, propriétés médiévales ou exploits modernes), parfois controversés et confus, parfois mal ou insuffisamment connus. Le moment est venu pour rendre hommage à l’initiateur de ces recherches d’histoire familiale, Arthur Gorovei (1864-1951), écrivain, avocat, folkloriste, membre de l’Académie Roumaine – entreprise difficile, car ces recherches constituent une section assez peu connue de sa longue et vaste activité, tandis que les sources nécessaires pour la connaître sont plutôt maigres (des notes plutôt furtives dans son Journal ou plus détaillées dans ses Mémoires, plusieurs lettres adressées à des amis avec lesquels il partageait la passion pour l’histoire et la généalogie et, sans doute, les manuscrits mêmes). Depuis ses études universitaires (à la Faculté de Droit de Jassy), l’histoire est devenue une passion très forte et par cette voie il est arrivé à l’histoire de sa propre famille, dont il commença à s’intéresser vers 1888 pour n’en finir qu’au seuil de son trépas. Durant cette longue période (plus de six décennies !), il a ramassé une importante quantité d’informations historiques concernant les porteurs du même patronyme que lui, ainsi que les familles apparentées. L’arbre généalogique établi vers 1894 (après la naissance de son premier fils), un premier essai de synthèse vers 1914 (Însemnări despre familia Gorovei) et l’arbre généalogique imprimé en janvier 1934 ont marqué des étapes importantes de cette longue route vers la monographie finale (Istoria familiei Gorovei), dont le début a été fixé par lui-même en 1944. Le travail prit un rythme plus accéléré vers la fin de sa vie; dans les années 1945–1949, il a complété l’histoire de sa famille avec l’histoire de quelques familles apparentées. Le point final fut mis le 8 octobre 1950, en ajoutant une note datée (la seule qui porte une date, parmi des centaines de pages...). En même temps, il s’est intéressé à l’histoire et à la généalogie de la famille Gorove(i) de Transylvanie et de Hongrie, Arméniens magyarisés de confession catholique-romaine, dont certains, à l’époque, affirmaient leur origine commune avec les Gorovei de Roumanie. Des obstacles inhérents n’ayant pas permis des recherches plus approfondies, Arthur Gorovei dut se contenter des informations trouvées dans de vieux travaux généalogiques hongrois et de celles offertes par quelques membres de cette famille qu’il eut la chance de connaître. Par conséquent, il lui fut impossible de se pencher vers une solution ou vers l’autre: une origine commune (fut-elle très éloignée) ou une coïncidence aléatoire des patronymes. Et jusqu’à la fin, il oscilla entre ces deux solutions. Il lui fut également (et malheureusement) impossible de connaître l’existence des porteurs du même patronyme qui vivaient dans leurs foyers ancestraux, répandus dans quelques départements de Moldavie: les conditions économiques et sociales ne favorisaient pas leur apparition à la surface de la vie sociale ou dans les pages des journaux de l’époque. Par conséquent, leur existence même était presque insoupçonnable. Les résultats de ces recherches, déployées pendant six décennies par Arthur Gorovei, ont permis á l’auteur de la présente étude de reprendre et de continuer l’investigation de l’histoire familiale, ce qui justifie l’hommage rendu ici à son précurseur.

În această secțiune a NRDO publicăm două documente de referință pentru dezbaterea internă asupra politicii de combatere a COVID-19. Prima este opinia Consiliului Național pentru Combaterea Discriminării cu privire la proiectul de lege prin care se stabilesc măsuri în domeniul sanitar, pe perioada stării de alertă, pentru personalul din cadrul unor unități publice și private. Opinia a fost solicitată de către Comisiile Senatului cu competențe în avizarea proiectului: Comisia juridică, de numiri, disciplină, imunități și validări, Comisia pentru drepturile omului, culte şi problemele minorităților naționale și Comisia pentru Sănătate. Comisiile au de avut în vedere că CNCD este autoritate de stat autonomă, „garant al respectării şi aplicării principiului nediscriminării”. Am considerat binevenit să publicăm Decizia Curții Constituționale a Republicii Moldova din 30 octombrie 2018 privind constituționalitatea prevederilor care stabilesc că admiterea copiilor în colectivităţi şi instituţii educaţionale şi de recreere este condiţionată de faptul vaccinării lor profilactice sistematice (art. 52, (6) al Legii nr. 10 din 3 februarie 2009 privind supravegherea de stat a sănătăţii publice). Curtea Constituțională a fost de acord că prevederile normative contestate limitează drepturi fundamentale. Însă, a subliniat Curtea, în aceeași măsură, ele promovează drepturi fundamentale. Tratamentul diferențiat al copiilor vaccinați, în comparație cu copiii nevaccinați, dar care pot fi vaccinați este justificat în mod obiectiv și rezonabil. Amintim aceste argumente care privesc vaccinarea copiilor întrucât ele au relevanță și pentru vaccinarea contra Covid-19.
