Proces socijalnog uključivanja u Bosni i Hercegovini u kontekstu evropskih integracija

Social inclusion is a process which ensures that persons, who fall into risk group and who are in threat of poverty and social exclusion, are given an opportunity and necessary resources in order to fully participate in economic, social and cultural life, and also the opportunity to enjoy a standard of living and prosperity, which is considered normal in a society in which they live. By social inclusion is ensured that an individual is fully involved in decision making processes directly related to his/her life and access to basic economic, social and political rights. The process of joining the EU provides a basis for strengthening social inclusion in Bosnia and Herzegovina, due to the needs to implement European standards in the context of social exclusion, as well as policies for its reduction. In order to join the European Union, Bosnia and Herzegovina must build capacity to address problem of social exclusion, and fulfill the preconditions relating to the social dimension of the European Union. Therefore, the issue of social inclusion is one of the main issues of development in Bosnia and Herzegovina, because it is important that Bosnia and Herzegovina provide better future to it’s citizens.

Ostvarivanje socijalnih prava u BiH: nejednakost građana

The article analyzes the issue of achieving social rights in Bosnia and Herzegovina through the amount of cash benefits for people with disabilities in accordance with Entity regulations on social security, veteran - disability protection, protection of civilian victims of war, and pension and disability insurance. In fact, despite the constitutional provisions on guaranteeing social rights and prohibition of discrimination, and international commitments of the state and all levels of governments, which have become valid upon entry into force of the UN Convention on the Rights of disabled persons, and other international legal documents pertaining to insure social rights in Bosnia and Herzegovina, the most vivid example of inequality is visible in the treatment of persons with disabilities by the government. This inequality is reflected in set conditions and the amount of cash benefits, as well as other rights guaranteed which is done in accordance with cause of disability, but should be done according to estimate of needs of persons with disabilities (regardless of the cause of the disability) for more effective inclusion in society.

Ostvarivanje prava iz mirovinskog i invalidskog osiguranja u BiH: (ne)jednakost građana

The author discusses the issue of equality and inequality in achieving rights from pension and disability insurance in Bosnia and Herzegovina through the analysis of the set conditions related to insurance and age limits regarding the rights to old-age pension in accordance with the general provisions on the pension and disability insurance, and special regulations on the retirement in both entities. A special problem of inequality occur due to differences in incomes of pensioners, beneficiaries of the entity’s pension found institutions and disability insurance, for the persons who were granted retirement before the war, with a single insurance found institution and the single economic space. This is an open problem that burdens the insurance institution in the entities. In the conclusions and recommendations, the author suggests modalities to resolve the issues of inequality by strengthening the role of state government levels.

Uredba Europske Unije 883/2004 i ugovori o socijalnom osiguranju s državama nasljednicama SFR Jugoslavije

Nakon primitka Republike Hrvatske u članstvo Europske unije za novu državu članicu otvorilo se pitanje odnosa ugovora o socijalnom osiguranju koje je Hrvatska nakon 08. listopada 1991. sklopila i primjenjuje sa ostalim državama, a posebno onima nastalim na tlu bivše SFR Jugoslavije koja je dotle predstavljala jedno državno područje i jedinstveno tržište rada, sa usklađenim socijalnim zakonodavstvom. Na njemu su razdoblja provedena kod nositelja socijalnog osiguranja pojedinih republika i pokrajina imala jednaku vrijednost u pogledu ostvarivanja prava iz mirovinskog osiguranja, kao i prava iz drugih grana socijalnog osiguranja. Slijedom učinka jedinstvenog tržišta rada i slobode rada na području čitave bivše federalne države, mnoge su osobe navršile mirovinski staž u više raznih tadašnjih republika i pokrajina, danas zasebnih država. Također, zbog značajne ekonomske emigracije, koja traje još od šezdesetih godina prošloga stoljeća, veliki broj osoba s područja bivše SFR Jugoslavije zapošljavao se i radio po državama članicama današnje EU (i tamo bio osiguran), a dio njih danas ima i njihovo državljanstvo, tj. državljani su EU. Danas ta razdoblja mirovinskog staža, navršena u Hrvatskoj, Sloveniji, drugim državama nastalim iza SFR Jugoslavije, te u ostalim državama članicama EU, predstavljaju očekivana prava iz socijalnog osiguranja za navedene osobe. Naime, za te osobe ponekad je od presudne važnosti da im se pri odlasku u mirovinu ili u drugim situacijama u kojima ostvaruju neko pravo iz socijalnog osiguranja, kada je to potrebno, uračunaju sva razdoblja osiguranja koja su navršile u svim državama njihova rada i da im se prizna pravo na davanje prema zakonodavstvu države u kojoj su radili i bili osigurani. U vezi s time, valja napomenuti da je odlukom Suda Europske unije u predmetu Gottardo određeno da se u svrhu ispunjenja uvjeta mirovinskog staža za starosnu mirovinu uzmu u obzir i razdoblja staža osiguranja navršena u trećoj državi, s kojom jedna od država članica primjenjuje ugovor o socijalnom osiguranju. Radi toga, ovdje će se ispitati pravne mogućnosti za realiziranje prava navedenih osoba u novonastalim uvjetima primjenom Uredbe 883/2004 i ugovora o socijalnom osiguranju, koji su ostali i dalje na snazi i u primjeni.

Family Policy: Parental and Maternity Leave in the Context of Work-Life Balance and Equal Opportunities for Women and Men

Family policy in the context of parenting and equal opportunities is a system of provisions, programs and policies sharing the common goal of supporting families and other types of partnerships. They are financial, material and legislative instruments that influence people’s decisions about family and having children. The foundation of family policy is the form of maternity and parental leave, possibly including the provision of father leave . The goal of family policy in regard to parenting should be the creation of a family-friendly environment in which people can freely decide whether they want to have children and how many. In such an environment people need not worry about their and their children’s socioeconomic situation and about their future, and can therefore freely decide to have as many children as they really wish. In the long term, this approach to parenting support is more effective than temporary pro-population measures which typically aim to stimulate the birth rate of some age groups but do not create stable conditions for parenting in the long run. Creating and fostering a positive environment is also more useful than implementing policy approaches based on penalizing one-child or childless families as some family policy or retirement concepts propose. Family policy that observes equal opportunities principles and promotes work-life balance, allows for a variety of life strategies both for those who decide to balance work and family as well as for those who prefer to look after their families full-time. Neither social group should be neglected or discriminated against – be it by the system of maternal and parental leave or by an associated policy (the retirement system, for instance), as it happens today. A good system of maternity and parental care is grounded in anti-discrimination principles which actively prevent discrimination of parents and other caregivers and promote equal opportunities. Ideally, a family policy that provides equal opportunities does not support only the types of idealized family units that are in accord with the party lines of the governing political party. On the contrary, a fair family policy understands families are dynamic entities that take many of well-functioning and responsible forms. [...]

Gender audit of the EU pre-accession funds 1999-2004

Looking back into the closed period of the past could be rewarding and important for future decisions. Obviously, the decisions cannot be taken back but their outcomes may be, and often are, relevant in the following years. When it comes to finances and their division among programmes and projects, it is always interesting to assess the priorities and budgets after a certain distance in time to understand the processes and channels they passed through. The EU membership has opened a lot of new challenges for each of the accession countries. During the accession process, the countries had the possibility to finance institutional building or infrastructure development from the EU pre-accession instruments. After entering the EU, pre-accession instruments were replaced by Structural Funds. Economic impacts of the projects financed by all available instruments were relatively well documented and monitored. The projects had significant positive and negative social impact at national and regional level. Because of existing gender roles and stereotypes, the social “impacts” were not distributed equally between women and men. Moreover, the missing gender dimension on the project level helped conservation and strengthening of gender roles. That is briefly the first intent why the joint Czech and Slovak project was initiated in mid-2004. It focuses on analyses of programming documents, and a selected number of foundations re-granting European funds to local projects in both countries. Dear readers, We are pleased to bring to your attention Women on labour market: today and in the future, a book, which is one of the outcomes of the project Fit for Gender Mainstreaming - Gender-Sensitive Transcending of Borders between East and West. Based on cross-border qualification initiatives for multipliers and public events in all countries participating in the “East-West Dialogue”, the goal of the project is to advance gender mainstreaming strategies on a local level and enhance exchange of experiences and qualifications. The publication follows up the international conference Future of Women on the Labour Market, which took place under the auspices of Kateřina Jacques, a Member of Parliament, in Prague in October 2007. Our goal is to assess situation of women on the labour market, refer to persisting inequalities and inspire discussion about the future. We are aware of the fact that gender equality policies need a thorough evaluation to prevent biased application, which may lead to cementing gender stereotypes instead of disrupting them. Our texts address not only decision-makers, but they also represent a call for solidarity between women, since its lack often stands for a barrier in achieving equality. Thus, we decided to focus some of our current activities especially on women.

Penitentiary - Reformatory for Women in Požarevac

For the past ten years, the Helsinki Committee for Human Rights in Serbia has been monitoring and identifying violations of human rights of marginalized groups accommodated in various institutions, where their fundamental rights have been partially or entirely limited. After several visits to all prisons, during which the HCHRS has, based on a previously established methodology, ascertained the state of affairs, followed by a systemic monitoring of the changes in the execution of criminal sanctions, the new project aims to identify violations of rights of vulnerable groups among the prison population. Having in mind that the prison system is reforming at a slow pace and that many aspects are contingent on changes in the society and in other state sectors, the Monitoring of the Prison System Reform in Serbia 2011 focuses on the most prominent problems which threaten fundamental human rights of persons sentenced to prison or to educational measures, belonging to one or more categories of the so called sensitive groups. For this reason, the comprehensive methodology used in previous reports has given way to observance of existing rights which the abovementioned persons cannot realize fully or to some degree, in spite the pronounced social or individual need for such rights to be engendered in the case of these particular groups.

It is my great pleasure to introduce myself as the new Chairman of CEPS. Let me start by thanking my predecessor, H. Onno Ruding, who assisted CEPS’ management in growing the organisation to the globally recognised institution that it is today, while preserving its integrity and reputation for insightful and constructive ideas. I intend to continue in that tradition, bringing my expertise to the work of CEPS on some of the core issues on the European agenda in 2014. In particular, the complex arrangements to establish a Single Resolution Mechanism will be of major importance. CEPS will follow the work of the intergovernmental conference that is fleshing out the agreement, providing input and acting as a sounding board for its proposals.

The Protracted Rohingya Crisis in Bangladesh and the Prospects of a Resolution

The humanitarian crisis of nearly 1 million Rohingya who fled from persecution in Myanmar to Bangladesh is now in its third year, and the prospects for its end are distant. Although most refugees want to return to Myanmar, the chances of repatriation are low due to the reluctance of the authorities there. Prolonging the current situation threatens to worsen the living conditions of refugees, increase the burden on Bangladesh and perhaps pose a challenge to the security of the region. The international community should continue helping Rohingya, increase pressure on Myanmar and look for innovative ways to end the crisis.

Przedłużający się kryzys humanitarny Rohingów w Bangladeszu i perspektywy jego rozwiązania

Kryzys humanitarny blisko 1 mln Rohingów, którzy uciekli z Mjanmy do Bangladeszu, trwa już trzeci rok, a perspektywy jego zakończenia są odległe. Chociaż większość uchodźców chce wrócić do Mjanmy, szanse na repatriację są niewielkie z uwagi na niechętną postawę jej władz. Przedłużanie obecnej sytuacji grozi pogorszeniem warunków życia uchodźców, zwiększeniem obciążeń dla Bangladeszu i być może wyzwaniem dla bezpieczeństwa regionu. Społeczność międzynarodowa powinna kontynuować pomoc dla Rohingów, zwiększać presję na Mjanmę i poszukiwać innowacyjnych sposobów zakończenia kryzysu.

Attempts at Reforming Egyptian Demographic Policy

The population of Egypt, the EU’s second-most populous neighbour after Russia, will soon exceed 100 million. The fast pace of the population growth together with the country’s inefficient economy could spur new crises caused by rising unemployment and difficult access to drinking water and food resources, and by politics. The Egyptian government, in cooperation with the EU, U.S., and UN, launched programmes aimed at reducing the fertility rate. Limiting the pace of Egypt’s population growth should weaken factors inciting further destabilisation of the Middle East and North Africa.

Rekordowy odpływ kapitału z Rosji w 2014 r. jest najjaskrawszą konsekwencją rosyjskiej interwencji militarnej na Ukrainie. Jednak nie tylko inwestorów zniechęcają regionalny kryzys bezpieczeństwa i gospodarcza niepewność. Wstępne dane o roku 2014 i początku 2015 wskazują, że rosyjscy obywatele dużo liczniej opuszczają swój kraj, podczas gdy Rosja przyciąga mniej imigrantów niż wcześniej. Zmniejszanie się zasobów kapitału ludzkiego wraz z odpływem środków finansowych w dłuższym okresie mogą osłabić rosyjską gospodarkę i jej wpływy na obszarze postradzieckim.

„Csak abban a statisztikában hiszek, amit én hamisítottam” – így hangzik Winston Churchill egyik hires nyilatkozata. Sajnos Romániában nem ritka a közvélemény-kutatások közötti „háború”, ahol nem az a lényeg, hogy milyen eredményeket mutatnak az elemzések, hanem, hogy melyik intézménynek, pártnak, politikusnak nagyobb a támogatása, kit kell legitimálni. Az Országos I_úsági Hatóság rendszeresen végez vagy végeztet kutatásokat, hiszen meggyozodésünk, hogy pártszínezettol függetlenül minden kormány i úságpolitikájának az így szerzett eredményeken kell alapulnia. A romániai magyar atalok körében végzett kutatás az elso ilyen jellegu felmérés, amelyet román költségvetési nanszírozással készítettek. Az adatokat elemezve, összehasonlítva, számomra a legfontosabb következtetés, hogy mind a román, mind a magyar ataloknak pozitív a jövoképe. Nem önmagukban az egyes mutatók biztatóak, hanem a tendenciák. A zetéssel, munkahellyel, közérzettel, kivándorlással, oktatással, általános jóléttel kapcsolatos adatok az elmúlt években folyamatosan pozitív irányba mozdultak el. Ez a politikum számára mindenképpen reménykelto, de nem azt kell jelentenie, hogy elértünk egy folyamat végére. Tovább kell dolgozni a atalok számára biztosítandó lehetoségek bovítésén, és be kell vonni a atalok önszervezodéseit, hogy ezekbol a lehetoségekbol közösen eredményeket lehessen elérni.

The study presented here is the result of an anthropological field research undertook in the summer of 2004, continued by re-entrances in the field for almost three years, 2005, 2006 and 2007, in the area of Orăştie, Hunedoara county. The research considered here was lead by PhD. Professor Enikő Magyari-Vincze, to which the author participated as a field researcher. Although it does not have the purpose of an exhaustive analysis regarding the surviving strategies to which the members of the community resort through various contexts, in everyday life, it can be considered a guiding mark of an analysis concerned with different aspects which describe the life of this community.
