The coming into force of the new Law on the Enforcement of Criminal Sanctions (LECS) on 1 October 1998 and of the Decree on the Establishment of Institutions for the Enforcement of Institutional Sanctions on 23 May 1998 were major steps forward in reforming and modernizing our country’s system for the enforcement of criminal sanctions and its harmonization with relevant international legal acts. Nonetheless, although five years have passed since their adoption, a great many of their provisions are yet to be put into practice. What is more, although at the time of its adoption the new law was welcomed as a long-overdue innovation designed to meet the pressing need to bring our country’s legislation into line with relevant international standards, at the time of writing it appears obsolete and incompatible. This is why an analysis of the system of enforcement of institutional criminal sanctions in our country and its comparison to those of other countries on the basis of relevant legal provisions alone would be purely fictitious. We therefore decided against such an approach. The current state of affairs outlined above made our task much more difficult in many ways. Instead of concentrating on detecting ‘minor’ inconsistencies in the enforcement of criminal sanctions and contemplating ways of eliminating them, we found ourselves confronted with something we considered inconceivable, i.e. the absence of a single strategy, of a well-conceived system, and of a well-defined network of institutions. In so chaotic a climate, marked by disregard for even fundamental legal provisions (e.g. those determining the categories of institution, their classification, etc.), it was impossible to verify the general theoretical propositions on which the whole system ought to rest and consequently to see their practical implications. Instead, much of our effort consisted in detecting and discussing major derogation’s from the LECS and relevant international standards. The final chapter of this work comprises general conclusions based on the findings presented on the preceding pages, as well as recommendations for promoting the enforcement of criminal sanctions, primarily with a view to protecting the basic human rights of imprisoned or detained persons. In order to ensure systematic presentation and ease of reference, the conclusions and recommendations are subsumed according to their content under the six subjects discussed earlier.

The ‘lessons learned’ by the European Union in crisis management largely result from the EU’s considerable experience in the Western Balkans, which has helped it to develop its capabilities, institutions and instruments in the European Commission and the Council General Secretariat. A full range of civilianand military crisis-management tools, as well as development and humanitarian assistance, have been put into practice in support of the reconstruction of the Western Balkans, where the EU is now the lead international actor. This chapter concentrates on the implementation of EU efforts towards police reform in Macedonia, where the EU supports the peace process and seeks to bring the country closer to the EU. It provides an assessment of coherence at the operational level between inter-governmental and Community instruments, as well as cooperation between EU operations and other international actors active on the ground.

TRANS WOMEN PRISONERS IN TURKEY

Studies on trans prisoners are quite rare in spite of the steady increase in the number of studies and researches on LGBTI in recent years. Though there is some increase in the number of studies on LGBTI in general and trans prisoners in particular, these studies still remain quite limited both internationally and in Turkey. LGBTI individuals are often unprotected in the judicial system from discrimination and violence on the basis of their sexual identity and orientation. While some trans women and gay prisoners can conceal their identity, “excessive” visibility of trans women increases the risk of maltreatment and violence (ACLU&NCLR 2014; UNODC 2009). Further, those who are perceived as gay though not being so, may also face the same forms of violence.

Analizom ove sudske presude želi se ukazati na činjenicu da pravosudna zajednica nije dovoljno senzibilizirana prema predmetima krivičnog djela nasilja u porodici ili porodičnoj zajednici i da je, u cilju ostvarivanja optimalne zaštite žrtava nasilja u porodici i njegovog daljeg sprečavanja, neophodna daljnja edukacija svih nosilaca pravosudnih funkcija. U tom cilju izvršena je pravna analiza presude, kvalitativna analiza sadržaja presude kroz tok i trajanje postupka, analiza olakšavajućih i otežavajućih okolnosti, izrečenih sankcija i mjera sigurnosti, te prava na naknadu štete oštećenih kao žrtava nasilja.

Priznanje krivičnog djela: samo još jedna olakšavajuća okolnost

Nasilje u porodici ili porodičnoj zajednici kao krivično djelo predviđeno je članom 208. Krivičnog zakona Republike Srpske, a kako je do promjene Krivičnog zakona u Republici Srpskoj došlo donošenjem Krivičnog zakonika 2017. godine ovo krivično djelo je u Krivičnom zakoniku predviđeno članom 190. Prema Krivičnom zakonu Republike Srpske, za osnovni oblik krivičnog djela nasilje u porodici ili porodičnoj zajednici bili su predviđeni novčana kazna ili zatvor od tri mjeseca do tri godine. U Krivičnom zakoniku Republike Srpske za osnovni oblik krivičnog djela nasilje u porodici ili porodičnoj zajednici došlo je do promjene, pa je za osnovni oblik ovog krivičnog djela predviđena novčana kazna ili zatvor do tri godine.

Presuda je sudska odluka kojom se konačno i meritorno odlučuje o zahtjevu stranaka u postupku. Presuda mora biti kvalitetna jer predstavlja krunu cijelog postupka; ona mora jasno, precizno i logično prikazati zaključke do kojih je sud došao nakon provedenog postupka. Nije dovoljno da presuda bude pravno korektna, već mora biti i jezički i gramatički pravilna, lako čitljiva i razumljiva. Ono što sud kaže i način na koji to kaže podjednako je važno kao i ono što odluči. Za kvalitetnu presudu neophodno je kombinovanje vještine pisanja i pravnog znanja. Presuda je veoma značajan pravni akt koji sublimira čitav postupak i u njemu izvedene zaključke. Kvalitetna presuda zahtijeva poznavanje brojnih vještina, višestrano znanje, a takođe i poznavanje pravopisa, gramatike i logike. Social perception and legal treatment of offenses out of necessity

Most scientific research dealing with the topic of minor offenses out of necessity follow either Thompson’s idea of collective and organized moral economy of the (working class) masses, thus focusing on the revolt of the hungry, a characteristic of urban settings (of England and France). In political settings where the urban daily routine was not determined by the revolts of the hungry, the majority of research focuses on the mythicized forms of unorganized social rebel, living on the edge of society. The scope of this article is limited to the phenomenon of (minor) theft in times of hardship by linking both older theoretical concepts and significantly complementing them especially when addressing the issue of individual and collective perception of crimes (offenses) by necessity.

This publication provides a brief overview of the evolution of the Institute of Forfeiture of Illegally Acquired Assets under the Special Asset Forfeiture Act to the State, without claiming a detailed study of the historical development of the Institute. This review aims to outline the main characteristics of the institute, thereby clarifying its independent and independent character from other similar procedures existing in our domestic legislation, to outline the impact of European law on our domestic legislation, the legislative progress achieved and to focus on its preventive function as an instrument in the fight against crimes that have the potential to generate benefits for their perpetrators. The other objective of the study is to clarify the fact that the latest legislative changes are not a step backwards, but have been undertaken in order to differentiate the functions of the two anti-corruption bodies.
