Recommendation CM / Rec (2007) 7 of the Committee of Ministers of the Council of Europe on good administration and the Code of good administration are particularly examined, as well as Article 41 of the Charter of Fundamental Rights of the European Union enshrining the right to good administration, including the European Code of Good Administrative Behavior, which elaborates on the details of the right.

THE PRINCIPLES OF LAW: PHILOSOPHICAL APPROACH

Any scientific intercession that has as objective, the understanding of the significances of the “principle of law” needs to have an interdisciplinary character, the basis for the approach being the philosophy of the law. In this study we fulfill such an analysis with the purpose to underline the multiple theoretical significances due to this concept, but also the relationship between the juridical principles and norms, respectively the normative value of the principle of the law. These us are being materialized extensive references to the philosophical and juridical doctrine in the matter. This study is a pleading to refer to the principles, in the work for the law’s creation and applying. Starting with the difference between “given” and ’’constructed” we propose the distinction between the “metaphysical principles” outside the law, which by their contents have philosophical significances, and the “constructed principles” elaborated inside the law.

W niniejszym artykule zostaje sformułowana teza o konieczności prowadzenia badań z zakresu deliberatywnej filozofii nauk administracyjnych. Wprzódy zostają wskazane trzy przesłanki ogólne do sformułowania tej tezy, tj: 1) zasada demokracji ujmowana na gruncie demokracji deliberatywnej jako współźrodłowa z zasadą praworządności; 2) deliberatywna filozofia publiczna, która w nastawieniu kontekstualno partykularnym ujmuje adresata prawa jako pełnoprawnego uczestnika namysłu nad prawem oraz 3) abstrakcyjna zasada autonomii woli, zgodnie z którą adresat prawa powinien móc także rozumieć siebie jako twórcę prawa. W krokach następnych te zasady ogólne analizowane są w kontekście triady nauk administracyjnych gwoli uszczegółowienia i kontekstualizacji tezy głównej.

Refleksje na temat dynamiczności i deliberatywności wykładni trudnych przypadków na przykładzie spraw dotyczących osób LGBTQ+

Artykuł rozważa liczne konteksty i wielopłaszczyznowość prawa do obywatelstwa, posiadania prawidłowego aktu stanu cywilnego, czy też korzystania z ulg bądź zwolnień podatkowych na takich samych zasadach jak inni obywatele, np. pozostający w związkach heteroseksualnych. Ukazuje ono, jak skomplikowane stało się orzekanie w sprawach, które ze względu na przedmiot regulacji powinny być względnie jednoznaczne i przewidywalne. Refleksyjność wykładni prawa pozwala uwzględnić nieeliminowalny aspekt jego zmienności, jak również płynność znaczenia pojęć i zwrotów użytych w tekście prawnym, co nakłada obowiązek odwołania się przez interpretatora do pozajęzykowych kontekstów wykładni, a więc do argumentów funkcjonalnych i systemowych. Autor wskazuje, że nie jest możliwe właściwe zrozumienie aktualnego kontekstu prawnego bez analizy kontekstu społecznego i kulturowego, zwłaszcza przy uwzględnieniu pluralizmu wartości jako modus vivendi społeczeństwa demokratycznego.

Epistemologia stosowania prawa a zasada demokratycznego państwa prawnego

Artykuł analizuje epistemologię instytucjonalną procesu stosowania prawa w Polsce. Jest ona rozumiana jako zestaw cech, celów poznawczych, wartości, praktyk wpisanych w strukturę instytucjonalną. Analizowane są dwie podstawowe cechy tej epistemologii: pozytywistyczny model poznania oraz koncepcja prawdy. W artykule wskazuję jak te cechy zostały ukształtowane i dlaczego współcześnie należy uznać je za ograniczające. Argumentuję, że legitymacja procesów decyzyjnych opierających się na tych założeniach jest z punktu widzenia zasady demokratycznego państwa prawnego niezadowalająca, i dlatego cechy te powinny ewoluować w kierunku deliberatywnym.

Filozofia prawa dla sędziów społecznych. Perspektywa Hegla i Fichtego

Po zarysowaniu kontekstu historycznego artykuł konstruuje normatywne uzasadnienie partycypacji obywateli w publicznym wymiarze sprawiedliwości na gruncie filozofii prawa Georga W.F. Hegla i Johanna G. Fichtego. Ich komplementarne filozofie prawa dają podstawy współczesnej filozofii prawa dla sędziów społecznych (in. ławników lub sędziów honorowych). Autorka dowodzi, że Heglowskie ujęcie ławnika jako podmiotu, który realizuje „prawo do samowiedzy” w sferze politycznej i prawnej i stanowi integralną część instytucji wymiaru sprawiedliwości ma większy i bardziej aktualny potencjał niż jego Fichteański odpowiednik. Sędziowie społeczni u Fichtego działają poza ramami prawa, na mocy obywatelskiej umowy o samopomocy prawnej na wypadek wyższej konieczności. Wszystkie dociekania i analizy, udokumentowane źródłami z uwagi na nowość problematyki, wiodą do następujących konkluzji: 1) działalność sędziów społecznych u Fichtego „unieważnia” prawo nieudolne, wadliwe lub niesprawiedliwe i w ten sposób antycypuje Formułę Radbrucha; 2) heglowscy ławnicy wpływają na realną transformację nowoczesnego, zatomizowanego społeczeństwa w społeczeństwo polites, transformują instytucje w ciała publiczne w mocnym sensie tego słowa; wreszcie przeciwdziałają alienacji społeczeństwa i prawa.

Zasada udziału czynnika społecznego w procesie karnym a legitymizacja wymiaru sprawiedliwości

Niniejszy szkic zawiera analizę zasady udziału czynnika społecznego w procesie karnym. Zaakcentowano przede wszystkim dyrektywalne ujęcie tytułowej zasady, w tym sensie starano się argumentować o jej roli interpretacyjnej na gruncie wykładni przepisów kodeksu postępowania karnego. Analiza objęła odtworzenie zakresu podmiotowego, przedmiotowego i temporalnego zasady udziału czynnika społecznego w procesie karnym. Wyróżniono ujęcie sensu stricto, sensu largo i sensu largissimo zasady udziału czynnika społecznego w procesie karnym. Przy czym ujęcie sensu stricto, obejmuje pełnienie przez obywateli funkcji rozstrzygającej w procesie karnym, obecnie realizowanej w sądach powszechnych w postaci udziału ławników w składach mieszanych; ujęcie sensu largo, zawiera także realizację innych ról procesowych przez obywateli poza funkcją orzeczniczą, natomiast ujęcie sensu largissimo, obejmuje także udział niezindywidualizowanych obywateli w charakterze publiczności rozprawy sądowej lub posiedzeń jawnych, a także realizację funkcji denuncjacyjnej. Rozważania szczegółowe objęły analizę realizacji funkcji orzeczniczej. W tym zakresie wykładni poddano art. 28 k.p.k., głównym pytaniem badawczym było to czy udział czynnika społecznego w procesie karnym na gruncie prawa obowiązującego legitymizuje wymiar sprawiedliwości w sprawach karnych.

Uwagi o wydawaniu sądów moralnych przez sędziów społecznych w polskim procesie karnym

Artykuł podejmuje problematykę udziału sędziów społecznych w wydawaniu sądów moralnych, podczas etapu wyrokowania w procesie karnym. Stara się realizować postulat integracji zewnętrznej prawoznawstwa, poprzez połączenie w pracy badawczej dorobku nauk prawnych oraz filozofii moralnej i filozofii publicznej.Podstawowe tezy artykułu są następujące. Sędziowie społeczni-obywatele posiadają kompetencje moralne, aby wydawać sądy moralne w procesie wyrokowania. Nie ma dobrych powodów, aby przyjmować, że sędziowie zawodowi są lepiej przygotowani do wydawania sądów moralnych, aniżeli ławnicy. Poszerzenie składów orzeczniczych o obywateli można traktować jako remedium na: konformizm, ignorancję, błędy intelektualne w dyskursie sądowym. Co więcej, obywatele są w stanie wzbogacić proces sądowego stosowania prawa o arystotelejską kategorię słuszności. Artykuł przedstawia również zagrożenia wynikające z udziału ławników w procesie ferowania ocen moralnych w postępowaniu karnym.

Self-Driving Vehicles. A Perspective on Ethics

This paper approaches this subject from a different perspective by defining what automation means in other areas of transportation as well as ethical problems regarding the operation of this kind of vehicle. In the later part although of equal importance discuss the operation of the autonomous vehicle from a security and data privacy point of view. This paper tries to define autonomous vehicles by comparison with other ways of transportation which have a higher degree of automation and defines what autonomous vehicles might impact our lives and our privacy.

Salus populi jako korektiv rozhodování v pandemických situacích: past, nebo cíl?

The article focuses on the ways of dealing with the crisis (epidemic) in the works of seventeenth-century legal philosophers (Hobbes, Spinoza, Mansvelt, Locke) and works of fiction (Mann, Camus, Čapek) and explores the possibilities of their use in the contemporary environment of the legal system of the Czech Republic. The article concludes that the methods used in this literature are transferable to the present day and can thus offer at least the contours of rational regulation. Specific limits of the law, arising not only from purely legal reasoning, but also from literature (including the early twentieth century in the Czech Republic), are a possible basis for our contemporary legal identity.

‘Improve the Law’ as a Judicial Duty on the Borderlines of Free Speech: Judges as Responsible Epistemic Agents

This paper discusses judicial duty of improving the law on epistemic grounds andclaims in that regarding this obligation, it is possible to give a place to free speechfrom an epistemic point of view. As a requirement of having epistemic agency,judges like other human beings have epistemological responsibility. Different fromthe others’ responsibility, judges’ responsibility is connected to their duty ofimproving the law, which is required by their job as well as the idea of the rule oflaw and judicial professional principles. Judges should improve the law’s capacityto guide the conduct of its citizens, who are obligated to obey the law. Improvingthe law also improves the delivery of justice. The ways of legal interpretation andjustification are important to improve it. While applying the law, judges can findthe law unclear or they may encounter some norm conflicts. In these cases, theyshould resolve them to keep the law ‘legally in good shape’, which should meetepistemological requirements. When fulfilling this obligation, judicial free speechon epistemic grounds should not be limited.

Wolność wypowiedzi sędziego w perspektywie pełnionych obowiązków

The aim of this paper is to present the issue of judicial freedom of expression inthe perspective of obligations that are inherent in the judicial role. The fulfilmentof such a task is dictated firstly by the presentation of an epistemic and egalitarianview of judicial humility. Based on this distinction I hypothesise two directionsof thinking about judicial freedom of expression. The epistemic variant, focusingon the role aspect, presents the judge as a special category of citizen due to the obligations connected with his or her profession. The egalitarian variant presents animage of the judge as a citizen. The whole study is completed by the justificationof the choice of a research topic. Among the reasons, technological changes and therelated development of social media deserve special attention.The implementation of the tasks mentioned above allows several conclusionsto be drawn. One of them concerns the mentioned hypothesis, which is given a correction. The other conclusion, in turn, concerns the variables in view of which thescope of judicial freedom of expression can be examined. The first of these is the spherein which the judge’s expression occurs, the second is the object of that expression, andthe third variable is the cultural aspect.

On the grounds of the analysis made the following conclusions are reached: the objective truth is a standard important for the moral, and to a large extent for the law, which is to reach widely applicable and indisputable conclusions based on the presence of verifiable facts that do not depend on subjective evaluations; the judicial (litigation) truth is based on the objective truth as it objectifies it by the use of the methods specific for the law, in particular, by including the objective truth in one or another subsystem of law; however, the judicial truth cannot be considered a „standard“ for the objective truth. The restrictions resulting from methods specific for the law cannot allow such a „standard-based“ determination of the objective truth; the objective truth is determined in its judicial form by the respective system characteristic of one or another branch of law.

Rola stanu ogólnego a znaczenie instytucji publicznych w Zasadach filozofii prawa Hegla

The text analyses the activities that are delegated by Hegel to the univer-sal estate in his Philosophy of right. The characterization of these activities is very superficial, despite the extremely important role assigned to the representatives of this group within the totality of the social structure. The universal estate should, according to Hegel, address the universal good and prevent the disintegration to which the blind laws of modern economics lead. Accordingly, the universal estate should represent a kind of supreme common good and should provide the criteria for its understanding to the rest of the public institutions. The meaning of Hegel’s text, however, is ambiguous. On the one hand, he attributes an extraordinarily high rank to these institutions, differing himself from the proponents of an atomistic social ontology; on the other hand, the elaboration of the characterization of the universal estate leads to a neoliberal understanding of the role of institutions. This role would come from the fact that the universal estate is defined by the negation of all particularistic interest and by master’s attitude of confronting negativity. The universalization of this pattern in civil society leads to the ideological concept of the heroic entrepreneurship and its institutionalization as a paradigmatic way of understanding the common good.

Human Freedom According to the Views of Aristotle of Stagira: Analysis of Its Doctrinal Category Using Gerald MacCallum’s Extended Formula of Freedom

Among contemporary researchers of the concept of freedom, there is complete agreement about the importance that Isaiah Berlin’s October 31, 1958, inaugural lecture “Two Concepts of Freedom”, given at the University of Oxford, has contributed to science. Published later and reprinted many times, it reorganized reflection on the concept of freedom by introducing the terms positive and negative freedom. Despite the appearance of numerous critical voices in the literature on the subject, it is certainly impossible to practice science today without recalling the aforementioned dichotomy. Nine years later, Gerald MacCallum – inspired by, i.a., Berlin’s theory – presented his own triadic model of freedom. In my research, I use this model, but extend its scope with an additional dimension of internal and external freedom. Therefore, the aim of this article is to reconstruct the category of human freedom present in the views of Aristotle of Stagira, carried out precisely by applying the extended formula of MacCallum and building its model with the use of the introduced research instruments. The adopted multidimensional perspective of observing human freedom allows for a comprehensive approach to various planes of human life, on which we can see the manifestations of this enigmatic and ambiguous concept that we call freedom.

On Theoretical Aspects of the Concept of Rational Lawmaker: Between Optimization and Idealization of the Legislation

The concept of the rational legislator plays an important role in the theory and philosophy of law, both in its historical-doctrinal and contemporary dimensions. It occurs in two main versions. The first one is associated with optimization models, which define the conditions for treating the legislative practice as a rational activity and the legislator as a rational actor. The second version, associated with the so-called Poznan Theoretical School, expresses itself in the assumption of the legislator’s rationality, which is a-factual in nature, both in terms of subject matter and objects of activity. It plays an important role in the process of legal interpretation, which is particularly evident in relation to the operative (judicial) interpretation. The study shifts the scope of the assumption of rationality of the legislator from the subjective point to the result of legislative actions in the context of expanding the set of sources (carriers) of law beyond legal regulations and binding it to a broad category of the legal order, including the actions of the judiciary and expanding the set of carriers of law to include court rulings and extra-legal criteria used in the processes of law application. This gives the idealization assumption about the rationality of legal order a real dimension, a potential element of which is the judicial “correction” of the results of legislative activity.

Between Normativism and Phenomenology: on the Influence of Adolf Reinach’s Concept of Social Acts on Szymon Rundstein’s Theory of Law

This text is devoted to commemorating Professor Tomasz Bekrycht, who was an eminent expert in the phenomenology of law. His interests focused particularly on the analysis of the philosophical and legal views of Adolf Reinach. The undoubted achievement of Professor Tomasz Bekrycht is that he restored the works of Adolf Reinach to Polish theory and philosophy of law. This study focuses on the references to A. Reinach’s concept of social acts in the indicated work by Szymon Rundstein, who does not ignore the concept of social acts in his considerations, but treats it as an interesting theoretical and legal suggestion. While analysing the influence of phenomenological concepts on Rundstein’s theory, an important conclusion was made: as a normativist, Rundstein accepts the concept of the “basic norm” (Grundnorm), suggested by Hans Kelsen, which legitimises law (the validity of other legal norms within the system).
