A Hero Named (Twice) for the Frontier: The Landscape of the Grottaferrata Digenes Akrites

A Hero Named (Twice) for the Frontier: The Landscape of the Grottaferrata Digenes Akrites

Author(s): John Kee / Language(s): English / Issue: 1-2/2022

Keywords: Digenes Akrites ;middle Byzantine borderlands ;western medieval literature ;blood border lord ;concrete verbal presentation ;narrative strategies ;narrative blocks

The frontier is essential for Digenes Akrites, right down to the protagonist’s name: the “Two-blood Border Lord” or “Frontiersman of Double Descent.” For generations scholars have addressed the historical contexts of this tale of love and heroism set on the Middle Byzantine borderlands, yet the question of how the spaces of the poem function in literary terms remains largely unexplored. Focusing on the Grottaferrata or “G” version of the text, this essay argues that attending to the landscape of Digenes reveals much about both the work’s larger narrative strategies and the nature of its imaginative engagement with its setting. The concrete verbal presentation of space in G is occasional, sparing, and repetitive, but the text overall conveys a vivid impression of place. Taking inspiration from the recent comparative and theoretical revival in the study of Byzantine literature overall and of Digenes specifically, the essay adapts techniques from narrative theory and geography in order to understand how G draws such rich significance out of its limited repertoire of spatial markers. The resulting method enables us to set beside the storied forests of Western medieval literature a distinctly Mediterranean or western Asian terrain of adventure, drawn out of plains, hills, and passes, of mixed woods and scrub. Tracking such spaces across the poem’s two major narrative blocks – each centered on its own environment – demonstrates how, no less than the twin appellation of its hero, the Grottaferrata Digenes Akrites as a literary work is built out of landscape in both deep structure and incidental detail.

Revisiting the Rus Visitors to Louis the Pious

Revisiting the Rus Visitors to Louis the Pious

Author(s): Jonathan Shepard / Language(s): English / Issue: 1-2/2022

Keywords: material evidence ;secondary literature ;Byzantine ;emperor Theophilos ;longstanding Byzantine alertness ;Louis the Pious ;Theophilos ;Annales Bertiniani ;

In 1995 I suggested that a pattern of material evidence might relate to a group of visitors to, successively, the courts of the Byzantine emperor Theophilos (827–842) and his western counterpart, Louis the Pious (812–840). This article revisits the suggestion in light of material evidence and secondary literature published since which bear, directly or indirectly, on the visits paid by the Rhos to Louis at Ingelheim and, some three years later, by Theodosios Baboutzikos to Lothar at Trier. Without fully engaging with the burgeoning secondary literature or every item of material data of conceivable relevance, I discuss archaeological, numismatic and sigillographic finds relevant to the original report in the Annales Bertiniani from three areas where fresh archaeological data is in play: Riurikovo Gorodishche, Gnezdovo and the Baltic Rim (with particular reference to Birka, the Jutland peninsula and Zealand). Account is also taken of a couple of broader considerations offering the historical background to the finds. The first encompasses the ups and downs of Theophilos’ reign: his ambitiousness for victories at the expense of the Abbasids, meeting with disaster and humiliation at the hands of Caliph Al-Mu’tassim in 838, and his subsequent diplomatic, naval and military demarches in order to regain ‘ face’. The second historical point is broader still: the longstanding Byzantine alertness to distant sources of high-calibre military manpower and corresponding interest in the topography and communications of faraway regions. The Byzantines’ interest in northwest Europe is attested for the later sixth century, where literary evidence converges with that of artefacts from such sites as Prittlewell and Sutton Hoo. A similar alignment of Byzantine artefacts and literary evidence may yield comparable results, signalling a flurry of diplomatic overtures and Theophilos’ recruitment efforts over a short period, from c. 835 to 842.

Silk on the Northern Border of Byzantium: Intentions, Possibilities, Findings

Author(s): Martina Čechová / Language(s): English / Issue: 1-2/2022

Keywords: ;silk ;Cherson ;trade ;9th centuries ;Byzantine Empire ;Crimean Cherson ;Crimean pottery ;Moshchevaya Balka ;archaeological sources;

This article deals with the silk trade (or simply a movement of silk, because silk was not only intended for trade but was also used as a diplomatic gift) and the possible means by which it was imported into and exported from Byzantium across its northern border. More precisely, could such a trade be running through the Crimea? If so, when and on whose initiative? Both literary and archaeological sources indicate that the town of Crimean Cherson was crucial for the Byzantine Empire and in certain times, i.e., in the 6th and 9th centuries, it played a significant role in long-distance trade. If we put together the fragments of sources from both Cherson and elsewhere, e.g., the account of Constantine the Philosopher’s journey to the Khazars, the precious finds of silk in the Caucasian settlement of Moshchevaya Balka or fragments of Crimean pottery in Sarkel, etc., we can see the picture of Cherson as a lively town, through which goods and articles of all sorts (silk included) were passing.

THE LIFE IMPRISONMENT IN THE HUNGARIAN CRIMINAL LAW

Author(s): Dávid Ferenc / Language(s): English / Issue: 1/2023

Keywords: Hungarian criminal law; life imprisonment; right to hope; human rights

Among penalties, the imprisonment is imposed for a fixed duration or for a life term in Hungary. In many cases the duration of an imprisonment may be longer due to the fact that relative dangerous criminal offenses or special circumstances shall be punished differently. As a part of the imprisonment system, but above and on the top of the penalties the life imprisonment is taking place. This penalty is usually facultative and the judge may decide whether the perpetrator would be sentenced for a fixed-term imprisonment between ten and twenty years or to the life imprisonment. The key issues of an “effective” life imprisonment are the right to hope. In line with Hungarian criminal law the court may deny the possibility of parole in connection with sentencing a person for life imprisonment. In the case law of the European Court of Human Rights, Hungarian life imprisonment received special attention and also serves as an example for the sustainability of the current regulation. In this article the author shall guide through Hungarian regulation history and highlight the current system of penalties including the right to hope and the possibility of parole.

COMPARATIVE LEGAL REVIEW OF MARRIAGE IN SHARIA LAW AND POSITIVE FAMILY LAW OF THE REPUBLIC OF SERBIA

Author(s): Maida Bećirović-Alić / Language(s): English / Issue: 1/2023

Keywords: Sharia law; positive law; family law; marriage; family

Comparative legal analysis of natural and positive law has provoked various disagreements and discussions on the topic from the earliest periods of history. Proponents of natural law believed that such a comparison could not be made because natural law is true, irreplaceable and comes from God, while positive law has been regulated by man, following the example of all other rights that exist on earth. Positive law defines marriage as a community of life governed by legal norms, which is an expression of the undoubted interest of society to make marriage a legal institution, and the Qur’an, as a main source of Sharia law, categorizes the institution of marriage on a very precise system based on the strongest and safest principles that guarantee happiness to spouses, peace and morality to communities and society. The aim of the research is to present the understandings of natural-legal and positive-legal theory of law through a comparative analysis of the institute of marriage in Sharia law and law of the Republic of Serbia where the focus on this and similar issues should not be the “compatibility” of Sharia with “universal human rights norms” or vice versa, the focus should be on explanation and approaching of norms in order to make it easier to overcome, understand and accept differences.

Polowe organy administracji wojska polskiego w sprawach rekwizycji żywności w okresie powstania listopadowego 1830–1831 roku

Author(s): Marcin Konarski / Language(s): English / Issue: 1/2022

Keywords: history of administration; provisioning the army; wartime contributions; requisitions; November Uprising;

The article concerns the organisation and activities of the army food administration, which for most of the time during the November Uprising was carried out by the Army General Commissariat Service. During the 10 months of the uprising, the food administration underwent several organisational changes, and its execution was entrusted to various bodies. The discussion undertaken is related to issues concerning the organisation of this administration, with particular emphasis on the characteristics of the activity of its field administrative apparatus, which was entrusted to War Commissioners at individual army divisions and to Regional Commissioners as civilian requisitioning bodies in individual administrative regions which were links of the army’s food administration. On the other hand, in order to make the food requisitions enacted by the Sejm in June 1831 effective and rapid, Extraordinary Commissioners were established and entrusted with their supervision. In addition to the description of the powers conferred on all these officers, the author analyses the legal procedure applied by them to the requisitioning of food and fodder for the army against the background of events at the time.

Koncepcje samorządu terytorialnego w polskich konstytucjach dwudziestolecia międzywojennego (1918–1939

Author(s): Paweł Cichoń / Language(s): English / Issue: 1/2022

Keywords: local government; Second Polish Republic; the March Constitution 1921; the April Constitution 1935;

The article outlines concepts of local government based on the provisions of the Constitution of the Republic of Poland of 17 March 1921 (the March Constitution) and the Constitutional Act of 23 April 1935 (the April Constitution). In the first place, the assumptions of the March Constitution concerning the political system in relation to local government are presented, and then its influence on the formation of this local government in the Second Polish Republic is shown. The author outlines challenges and difficulties accompanying the attempts to adopt statutes on local government in line with the spirit of the March Constitution and outlines the legal basis for the organisation and activity of local government in Poland during the interwar period (1918–1939). Attention is also drawn to the changes in the approach of those in power to the role of local government which followed the May Coup in 1926 and were introduced in the Act of 23 March 1933 on the Partial Change of the Local Government System. The author also presents the legal position of local government in the April Constitution and indicates the ideas that underlay the creation of constitutional concepts of local government and how they were externalised in the specific political conditions. The article also provides a comparative analysis of the concept of local government resulting from the Constitutions mentioned above.

Małżeńskie ustroje majątkowe w Królestwie Kongresowym – na podstawie intercyz sporządzanych przez pierwszych łódzkich notariuszy

Author(s): Dorota Wiśniewska / Language(s): English / Issue: 1/2022

Keywords: The Kingdom of Poland; notary; Łodź (Lodz); marriage; matrimonial property law; joint property; property separation;

The Civil Code of the Kingdom of Poland (KCKP), enacted on June 1, 1825, stated that property relations in marriage could develop within the statutory property regime, which was the exclusive property regime or the contractual regime adopted by the spouses. KCKP regulated the principles of operation of the three main property regimes that could be introduced by agreement. The future spouses could simply bind their property relations to one of these regimes, or make any modifications to them. In addition, they were allowed to adopt a completely different, arbitrary system, as long as the rules of its functioning did not violate the law or good morals, and were specified in detail in the contract. The contractual systems regulated in the code were: property separation, dowry property regime and joint property. In practice of first notaries in the years 1841–1875 in Łódź, most commonly adopted property regimes were those that combined the features of two regimes, i.e. property exclusivity and joint property, or a dowry regime and joint property. However, the principles of the functioning of these systems adopted in premarital agreements were not uniform. The bride and groom decided on various combinations in terms of subjecting individual property components to property exclusivity, possibly to a dowry government, or joint ownership. The regimes of exclusive property and joint property as well as the dowry regime and joint property regimes were attractive for spouses, due to their flexibility, the possibility of adjusting the arrangements to the financial situation of future spouses.

Investor behavior around an initial public offering or private placement can make the difference between a successful investment or a potential loss. Through the present research, the correlation of investors' behavior with the possible discount of the share granted in the case of initial offers was sought. The large number of companies listed on the Bucharest Stock Exchange in 2021(23) compared to 2020(3) denotes the fact that the SARS-COV2 virus was a certain catalyst of interest for investors and companies to enter the Romanian capital market. From another point of view, we observe a strong orientation of companies towards MTF AeRO. Out of the total of 26 analyzed companies, only 3 of them chose the regulated market for trading.

The pandemic and the media system: The case of Norway

Author(s): Johann Roppen / Language(s): English / Issue: 18/2022

Keywords: media systems; Norway; Scandinavia; pandemic; digital media; newspapers; TV; media policy;

Norwegian media and journalism have for some time struggled to cope with the crises brought by digitalisation and globalisation: an increased output and accessibility of free digital media and social media, the loss of readership and advertising revenue of print media, layoffs of journalists and an gen-erally uncertain future of news. Put together these factors could possibly challenge the very foundation ofthe democratic corporatist media system of Norway. As the pandemic struck in 2020, one could expect themedia crises to get even worse and possibly bring changes of a systemic level. But Norwegian media have seemingly handled the pandemic quite well, and the media system has defi nitely not been rocked by it. Possible explanations for this state of affairs: the media’s handling of the pandemic, media policy in the pandemic and the long-term status of the digital transformation of the media, will be discussed here.

National dailies market in Nigeria: a five-year empirical study of newspaper business and its interactions with democratic practices in Nigeria

Author(s): Carl Chineme Okafor / Language(s): English / Issue: 16/2021

Keywords: Newspaper market; Nigeria; democratic practices;

Using an empirical approach and relying on core media management research theories — strategic management, structural contingency and the economic — for background, this research studied the financial situations of newspapers in Nigeria between 2015 and 2019 to find out how their prolonged financial difficulties interact with their ‘responsibility’ to Nigeria’s democracy. It found that the financial troubles of the newspaper market in Nigeria are manifested in the marked decline of traditional revenue sources, shutting down of bureaus and titles, retrenchment of quality hands as well as poor renumeration and non-payment of journalists’ salaries. Subtly and directly, these have impacts on Nigeria’s democracy, especially when it is considered that newspapers are valued civic engagement and accountability tools in democracy. The recurrent drop in circulation figures, closure of bureaus and retrenchment of quality manpower indicate that newspapers in Nigeria are in a precarious financial state, which affects their capacity to support profound democratic practices in the country.
