Summary/Abstract: The Treaty on European Union includes among its principles the one according to which member states must adopt an economic policy in accordance with the principles of an open market economy based on fair competition. The policy in the field of competition implemented by the European Commission and the authorities of the member states focuses on four areas of activity, namely the elimination of agreements that have the effect of reducing competition and the emergence of abuses of a dominant position, the control of mergers between companies, commonly known as “antitrust regulations,” the liberalization of monopolistic economic sectors, and monitoring of state aid. This policy aims to create a competitor that is real in the common market outlined by measures related to the structures of the market and the behavior of its actors. In this study we will address issues related to the legal basis of European policy in the field of competition, as well as the evolutionary path of competition policy.
