Summary/Abstract: Cases of participation in criminal procedure of a physical person who has suffered damages from the incriminated act, in atypical procedural qualities – defence counsel, counsel, state procedural body, civil defendant, attesting witness, have been researched. The prerequisites under which these specific hypotheses may arise, and the relevant procedural consequences, have been analysed. A conclusion has been reached that due to the lack of explicit rules, in some of these cases it is necessary to directly apply fundamental principles of criminal procedure.
