REDUCTION OF EXCESSIVE LIBERALITIES – PART III

Summary/Abstract: The first part of the study dedicated to reduction of excessive liberalities has proposed to present the regulation and notion of reduction of excessive liberalities, so that in the end to identify the categories of persons who can request the reduction of excessive liberalities, each category with it’s partcularities. In this part of the study we propose to present the rules established by the Civil code regarding the reduction of excessive liberalities, with the exceptions that each rule has. This part of the study presents the procedural ways to achive the reduction of liberalities, respectively the reduction by consent and judicial reduction.
