De lege ferenda own postulates of changing criminal policy within the area of practical application of the legal institution of conditional /.../

Summary/Abstract: The objective of this article is to present own postulates de lege ferenda concerning the action which should be undertaken in the area of effectiveness application of the conditional discontinuance of criminal proceedings within the framework of binding regulations. Own postulates will be presented as result of the author’s own research of 405 court cases from 2003-2009 which were drown using the multi-stage sampling method. Presentation will be connected with results of proposals of Polish Criminal Law Codification Commission. The presentation of the research issues will be analysed from the sequential stages of criminal proceedings.
