Summary/Abstract: The special nature of military life, the special organization of the armed forces, and strict discipline which governs it, often require that the disciplinary action rules deviate from their basic origin governing the scope of rules of ordinary penal procedure, in order to prescribe special rules which are better adapted to the military spirit. Therefore, in many contemporary national laws, the legislator aimed at creating a procedure which would reconcile and balance „the justice element and the military element” i.e. he intended not to burden the commander with unnecessary procedural niceties, as discipline demands quick, simple and efficient action.
